f) If an application for such permit is disapproved, the Zoning Officer <br />shall state in writing the cause for such disapproval. <br />g) The Zoning Officer shall issue a Stop Work Order pursuant to Article <br />23.2d if it is determined that irreparable injury will occur if the alleged <br />violation is not terminated immediately. <br />*21.4 Z_ oning Compliance Permit Required <br />*Amended <br />8/4/93 <br />9/16/03 It shall be unlawful to begin the excavation for the construction, the moving, <br />alteration, or repair, except ordinary repairs, of any building or other structure, <br />including an accessory structure costing more than $100 or exceeding one <br />hundred square feet in area, until the Zoning Officer has issued for such work <br />a Zoning Compliance Permit which includes a determination that plans, <br />specifications and the intended use of such structure does in all respects, <br />conform to the provisions of this ordinance. <br />Also, it shall be unlawful to change the type of use or type of occupancy of <br />any building, or to extend any use of any lot on which there is a <br />non - conforming use, until the Zoning Officer has issued for such intended use <br />a Zoning Compliance Permit, including a determination that the proposed use <br />does, in all respects, conform to the provisions of this ordinance. Issuance of <br />a Zoning Compliance Permit does not establish a vested right to begin and <br />complete construction or change the use /occupancy of a lot or building should <br />zoning regulations change subsequent to issuance of said permit. <br />Application for Zoning Compliance Permit shall specify the method of <br />disposal of trees, limbs, stumps and construction debris associated with the <br />permitted activity; which shall be by some method other than open burning. <br />The Zoning Compliance Permit shall expressly prohibit open burning of trees, <br />limbs, stumps and construction debris associated with the permitted activity. <br />21.5 Certificates of Occupancy <br />No building, structure, or zoning lot for which a Zoning Compliance Permit <br />has been issued shall be used or occupied until the Building Inspector has, <br />after final inspection, issued a Certificate of Occupancy indicating compliance <br />has been made with all the provisions of this ordinance. However, the <br />issuance of a Certificate of Occupancy shall in no case be construed as <br />waiving any provision of this ordinance. <br />21.6 Health Department. Approval Prior to Issuance of Certificate of <br />Occupancy <br />The Building Inspector shall not issue a Certificate of Occupancy for any use <br />of a structure or land served by wells for potable water and ground absorption <br />sewage disposal systems until the Orange County Health Department has <br />approved the water supply and sewage disposal systems serving that use. <br />91 -9 <br />
