e) upon findings, after a public hearing, that a change in a State or Federal <br />law or regulation precludes development of the project as approved. <br />Vesting of rights does not preclude the application of overlay zoning districts which <br />impose additional regulations, provided that the regulations are applicable to all <br />property subject to this Ordinance, and the allowable type and intensity of use is <br />not affected. <br />The vested right terminates at the end of the approved vesting period for buildings <br />and uses for which building permits have not been issued. Building permits do not <br />expire during the approved vesting period. <br />Amended <br />2/1/88 Volume /Capacity Analysis - The procedures used to compare the volume of a <br />roadway or intersection approach to its capacity (maximum number of vehicles <br />that can pass a given point during a given time period). The procedures are <br />described in the 1965 Highway Capacity Manual, Highway Research Board <br />Special Report 87. <br />Amended <br />1/4/94 Water- Dependent Structure - Any structure for which the use requires access to <br />or proximity to or citing within surface waters to fulfill its basic purpose, such as <br />boat ramps, boat houses, docks and bulkheads. Ancillary facilities such as <br />restaurants, outlets for boat supplies, parking lots and commercial boat storage <br />areas are not water- dependent structures. <br />Amended <br />5/20/03 Water Feature - A prominent aspect or characteristic of a geographic area that <br />exhibits verifiable evidence of a presence of water in the soil. Examples of water <br />features include, but are not limited to, perennial and intermittent streams, lakes, <br />ponds, reservoirs, springs, artesian wells, irrigation wells, marshes or swamps, <br />wetlands, and natural drainage ditches (non - ephemeral). <br />Amended <br />1/4/94 Watersupply Watershed (or Protected Watershed) Land that drains to existing <br />reservoirs which are public water supplies or potential reservoir sites or stream <br />intakes which have been designated for protection. All such lands have been <br />classified by the Environmental Management Commission as WS -II, WS -III or <br />WS -IV watersheds and require protection in accordance with the State Mandate. <br />Yard Space, Front - The required open space extending the full width of the lot <br />and to a depth equal to the required setback line, measured horizontally at right <br />angles to the rear lot line. <br />Yard Space, Rear - The required open space extending the full width of the lot <br />and to a depth equal to the required setback line, measured horizontally at right <br />angles to the rear lot line. <br />Yard Space, Side - The yard space of a lot which is established by and between <br />the street, or the lot lines, and the required setback line and which shall be open, <br />unoccupied and unobstructed by any structure or part thereof from the ground to <br />the sky, except as otherwise provided by this ordinance. <br />
