procedures authorized in Executive Order 11246 of September 24, 1965 <br /> and such order sanctions may be imposed and remedies involved as <br /> provided in Executive Order No. 11246 of September 24, 1965, or by <br /> rule, regulation, or order of the Secretary of Labor, or as otherwise <br /> provided by law. <br /> (g) The Contractor will include the provisions of paragraphs (a) through (g) <br /> in every subcontract or purchase order unless exempted by rule, <br /> regulations or orders of the Secretary of Labor issued pursuant to <br /> Section 204 of the Executive Order 11246 of September 24, 1965 so <br /> that such provisions will be binding upon each subcontractor or vendor. <br /> The Contractor will take such action with respect to any subcontract or <br /> purchase order as the contracting agency may direct as a means of <br /> enforcing such provisions including sanctions for noncompliance. <br /> Providing however, that in the event the Contractor becomes involved <br /> in or threatened with litigation with a subcontractor or vendor as a result <br /> of such direction by the contracting agency, the Contractor may request <br /> the United States to enter into such litigation to protect the interest of <br /> the United States. <br /> 8. Federal Labor Standards. The Contractor agrees to comply with the requirements of the <br /> Secretary of Labor in accordance with the Davis-Bacon Act as amended, the provisions <br /> of Contract Work Hours and Safety Standards Act (40 US Code 327-330), the Copeland <br /> "Anti-Kickback" Act (40 U.S.C. 276a-276a-5; 40 USC276c) and all other applicable <br /> Federal, state and local laws and regulations pertaining to labor standards insofar as those <br /> acts apply to the performance of this contract. <br /> The Contractor shall maintain documentation that demonstrates compliance with hour <br /> and wage requirements of this part. Such documentation shall be made available to the <br /> Town or the County for review upon request. According to the terms of the Copeland <br /> "Anti-Kickback" Act Provision, the Contractor shall be prohibited from inducing by and <br /> means, any person employed in the construction, completion or repair of public work, to <br /> give up any part of the compensation to which he is otherwise entitled. The grantee shall <br /> report all suspected or reported violations to the grantor agency(DCA). <br /> The Contractor agrees that, except with respect to the rehabilitation or construction of <br /> residential property containing less than eight (8) units, all contractors engaged under <br /> contracts in excess of $2,000 for construction, renovation or repair work financed in <br /> whole or in part with assistance provided under this contract, shall comply with Federal <br /> requirements pertaining to such contracts and with the applicable requirements of the <br /> regulations of the Department of Labor, under 29 CFR Parts 1,3,5 and 7 governing the <br /> payment of wages and ratio of apprentices and trainees to journey workers; provided, that <br /> if wage rates higher than those required under the regulations are imposed by state or <br /> local law, nothing hereunder is intended to relieve the Contractor of its obligation, if any, <br /> to require payment of the higher wage. The Contractor shall cause or require to be <br /> inserted in full, in all such contracts subject to such regulations, provisions meeting the <br /> requirement of this paragraph. <br /> 9. Access to Records and Record Retainage Clause. In general, all official project records <br /> and documents must be maintained during the operation of this project and for a period of <br /> 3 <br />
