BACKGROUND: The Board met with representatives of NCDOT at a public hearing on May 20, 2003 to discuss the proposed Orange County 2003 — 2004 Secondary Road Improvement Program, and to receive comments from citizens regarding the proposed program. The Board, after hearing comments from citizens, voted to close the public hearing and defer action to the next meeting at which the Board would also consider a policy for approving roads in the Secondary Road Improvement Program. NC General Statute §136 -44.8 provides that "the board of county commissioners may (i) concur in the construction program as proposed, or (ii) take no action, or (iii) make recommendations for deviations in the proposed construction program, except as to paving projects and the priority of paving projects for which the board in order to make recommendations for deviations, must vote to consider the matter at a later public meeting ". The referenced public meeting is a public hearing and requires the same public notification. "Any recommendation made by the board of county commissioners for a deviation in the paving projects or in the priority for paving projects in the proposed secondary road construction program shall state the specific reason for each such deviation recommended." If the Board wishes to make recommendations for deviations to the proposed 2003 — 2004 Secondary Road Improvement Program, the Board must vote to consider the proposed deviations at a public hearing, and publish notice of the meeting in a newspaper having general circulation in the County once a week for two succeeding weeks prior to the meeting. The Board must vote on the proposed deviations and state the specific reason for each.
