Arthur Minnis Road Right -of -Way Map <br />(Under Separate Cover) <br />PUBLIC HEARING: (YIN) No <br />INFORMATION CONTACT: <br />Craig Benedict, ext. 2592 <br />Karen Lincoln, ext. 2594 <br />TELEPHONE NUMBERS: <br />Hillsborough 732 -8181 <br />Chapel Hill 968 -4501 <br />Durham 688 4331 <br />Mebane (336)227 -2031 <br />PURPOSE: To concur, take no action, or make recommendations for deviations and setting a <br />public hearing for those recommendations, with respect to the Orange County 2003 — 2004 <br />Secondary Road Improvement Program proposed by North Carolina Department of Transportation <br />( NCDOT). <br />BACKGROUND: The Board met with representatives of NCDOT at a public hearing on May 20, <br />2003 to discuss the proposed Orange County 2003 — 2004 Secondary Road Improvement <br />Program, and to receive comments from citizens regarding the proposed program. The Board, <br />after hearing comments from citizens, voted to close the public hearing and defer action to the next <br />meeting at which the Board would also consider a policy for approving roads in the Secondary <br />Road Improvement Program. <br />NC General Statute §136 -44.8 provides that "the board of county commissioners may (i) concur in <br />the construction program as proposed, or (ii) take no action, or (iii) make recommendations for <br />deviations in the proposed construction program, except as to paving projects and the priority of <br />paving projects for which the board in order to make recommendations for deviations, must vote to <br />consider the matter at a later public meeting ". The referenced public meeting is a public hearing <br />and requires the same public notification. "Any recommendation made by the board of county <br />commissioners for a deviation in the paving projects or in the priority for paving projects in the <br />proposed secondary road construction program shall state the specific reason for each such <br />deviation recommended." <br />If the Board wishes to make recommendations for deviations to the proposed 2003 — 2004 <br />Secondary Road Improvement Program, the Board must vote to consider the proposed deviations <br />at a public hearing, and publish notice of the meeting in a newspaper having general circulation in <br />the County once a week for two succeeding weeks prior to the meeting. The Board must vote on <br />the proposed deviations and state the specific reason for each. <br />
