BACKGROUND: Orange County Speedway has requested that the County Commissioners approve a pyrotechnics permit for the fireworks display which is scheduled for June 28, 2003 in conjunction with the regularly scheduled race. GS 14-414 indicates that the Board shall consider a fireworks permit for "any and all kinds of fireworks and explosives, which are used for exhibitions or amusement purposes." GS 14 -413 empowers the Commissioner to authorize and issue permits for the use of pyrotechnics in connection with "...shows of all descriptions ... but only after satisfactory evidence is produced to the effect that said pyrotechnics will be used for the aforementioned purposes and none other." County policy further requires assurance from the sponsoring agency that adequate public safety measures will be exercised; and that the County will be protected as an additional insured on the insurance policy(ies) covering the event. The documents attached indicate satisfactory evidence that these requirements have been met. FINANCIAL IMPACT: There is no financial impact as a result of this action. RECOMMENDATION(S): The Manager recommends that the Board approve a pyrotechnics permit for the Orange County Speedway for June 28, 2003, or rain date as may be set; and authorize the staff to execute permits as needed.
