37 <br />G. Non Waiver. No failure or waiver or successive failures or waivers on the part of either <br />Party, its successors or permitted assigns, in the enforcement of any condition, covenants, <br />or provisions of this Agreement shall be deemed to be a waiver of enforcement for the <br />breach of any other provision in this Agreement or of any subsequent breach of the same or <br />other provision. <br />Section XVI.
