29 <br />B. The Grantee represents and warrants that all sums as may be awarded under this grant <br />shall be utilized exclusively for the purpose of the Project. The Grantee further represents <br />and warrants that the sums awarded under this Agreement shall not be used to substitute <br />or supplant funds the Grantee is currently using to support similar services that the <br />Grantee provides its clientele. <br />C. The Grantee agrees that funds awarded under this Agreement shall not be used for capital <br />expenditures or equipment expenses over $3,000, nor shall it use these funds to support <br />or engage in any effort to participate in political activities or lobbying, including but not <br />limited to support of or opposition to candidates, ballot initiatives, referenda and other <br />similar activities. <br />D. In the event the Grantee breaches any of the material terms or conditions of this <br />Agreement, the Grantee agrees to repay to the Commission the full amount of sums <br />awarded under this Agreement and any interest that has accrued on that sum. <br />Section V. Method and Use of Payments. <br />A. The annual amount of this grant must be spent pursuant to the Project budget contained in <br />Exhibit B, which is here incorporated by reference. <br />B. As soon after the Effective Date as possible, the Commission agrees to make an initial <br />payment of $20,338 to the Grantee which is twenty -five percent (25 1/o) of the total <br />amount of the first year of the grant. For this payment and all subsequent payments <br />under this Agreement, the Grantee shall place any sums not immediately spent in a <br />segregated, interest bearing account that is fully insured for the maximum amount of <br />money that will be placed in the account. Any interest accrued on these sums along with <br />any unspent funds remaining in the account shall belong to the Commission at the <br />conclusion of the Project. <br />C. Because of hardship demonstrated by the Grantee, the Commission agrees to waive a <br />25% hold back of grant monies that is normally payable only when the Project is <br />substantially completed. <br />
