The FONSI is referenced in the Special Use Permit Findings of Fact. <br />The Biological Inventory (see Attachment 1 ) Indicates that there are no substantial negative <br />environmental impacts associated with this development. All sensitive areas are either <br />undisturbed or protected with stream buffers or landscaped buffers. Two small, regulated <br />wetland areas were delineated. Both sites are either in proposed dedicated open space or <br />landscaped buffer areas. <br />conditional ' Use cU process: The CU process, which took the place of the Planned <br />Development II process as contained within the former Zoning Ordinance, involves the <br />approval of a rezoning petition and a class A Special Use permit to allow for the development of <br />a specific land use on a parcel of property. The process requires the approval of a site plan by <br />the BOCC. <br />It should be remembered that while this project 'is being processed under the CU review <br />standards as contained within the U o, there are submittal l requirements that this application <br />are not required to adhere to given the wording of Section 1.1.14 (C) of the UD .lost notably, <br />the applicant is not required to submit a formal `transportation Improvement Study as part of the <br />application. While the applicant has indicated they will submit traffic details at the public hearing, <br />ar formal study was not required as part of thi process. <br />The CU process requires a twb-step approval process, specifically: <br />1. A rezoning approval i.e. legislative process) in accordance with the provisions of Section <br />2.8 of the UDO and <br />2. A class A Special Use Permit (SUFI) approval i.e. quasi - judicial process) in accordance <br />with the provisions of Section 2.7 and 2. 9 of the UDO. <br />These review processes follow existing guidelines associated with the processing of such <br />requests.
