7 <br />The submitted site plan also denotes 3 open space areas, totaling 25,450 square feet of total <br />land area. <br />All of the development is confined to the central part of the subdivision diminishing the <br />'neighborhood feel' of the development. The location of the open space is forced to the <br />perimeter and there is little room left for development and centrally located open space. <br />STAFF COMMENT.- Section 6.8.6 the UDO requires that this project maintain a seventy- <br />five feet land use buffer separating the prefect from adjacent development. Per Section <br />` . 3. B ) (6) (conservation cluster projects are required to provide a 100 foot separation <br />from the building envelope for each lot and the project boundary. <br />The applicant has submitted proposals without the aforementioned open space/setback <br />requirements as they would effectively make the property undevelopable. Staff has reviewed <br />the proposal and agrees with the applicant that the reduction in required landscape buffer is <br />consistent with encouraging the development of the property at a reasonable density that is <br />consistent with surrounding uses and the components of the Comprehensive Flan. <br />A comparison of the conventional plan and the conservation cluster flexible development plan <br />gives a good overview of the design challenges that the 1 00-foot perimeter setback imposes can <br />smaller lots and lots of irregular shapes. Even though achieving 28 total lots on the flexible <br />plan, 12 of the lots are so severely restricted that they are of questionable quality for typical <br />residential uses. Another negative is that a large portion of the setback would be under private <br />ownership, not commonly owned H A property. This plan offers two undesirable options: <br />One; Being privately owned land encumbered for the benefit of adjoining property <br />owners or <br />Two: Open space land not owned by the HOA. Additionally, the two lots shown on the <br />eastern side of the Tinnin In d 'extensi n would not qualify Tinnln Road for acceptance <br />into the state maintenance system per NCD T agency review comments. <br />Therefore, the proposal ways prepared with a variable width IAA -owned buffer area along the <br />western, northern, eastern and a small portion of the southern boundaries. Combined with the <br />setbacks on each lot this would give a 55 to 6 -foot setback from the perimeter property line. <br />For these areas this represents 3 relief of the required landscape /open space requirement. <br />Staff does not object to the proposed reduction or open space configuration as proposed by the <br />applicant. <br />Parkland and Recreation: $11, 16 [$422 x 28 lots] shall be paid to Orange County as payment- <br />in-lieu of parkland dedication prior to recordation of the Final Flat.
