The applicant has been made aware of this potential condition and <br />has expressed no reservations. <br />Utilities - Water: The project is located within a Primary service Area as denoted on the water <br />and sewer Management, Planning, and Boundary Agreement ASAMP Map. orange - <br />laman a Water System Incorporated o s is the water utility provider for the area. <br />The applicant is proposing an " water line to serve the project. This line will be extended along <br />`innin Road from US Highway 70 then extend west along school House Road to service the <br />proposed lots. . <br />STAFF COMMENT: Planning and o ws staff: have determined that 12" water lines will be <br />necessary for this project. <br />In discussing this project with the orange County Fire Marshal, there is a concern over potential <br />dead end water lines being created. staff: has recommended to the applicant that a westward <br />connection to an existing 6" water line in the Richmond Hills subdivision be incorporated into the <br />project to provide secondary water flow. This will help with available water volume, provide for <br />sufficient water levels for fire suppression, and promote equalization of pressure within the water <br />network. <br />In order to adhere to this condition, a twenty 20 foot permanent recorded easement across the <br />common p <br />open ace of the Richmond Hills subdivision would be required, necessitating the <br />p <br />approval of the Richmond Hills HOA Board of Directors. An encroachment agreement with <br />NCDOT will also be required prier to the commencement of construction activities within Alice <br />Miller Court. Compliance with this condition perpendicular stream crossing will be required to <br />male the connection. <br />Staff had discussed with the applicant a condition requiring the extension of a new 8 IF water line <br />eastward to connect to the Ashwick subdivision. This condition, however, appears problematic <br />as it requires the applicant to secure an easement from a third party property owner not involved <br />with the project in order to comply. The applicant has expressed concern over the imposition of <br />this condition, as failure to secure the easement would result in a violation of the approval. <br />Staff has recommended that this become a condition of approval in the event County action on <br />the application is favorable. <br />The applicant has been made aware of this potential condition and has expressed the following: <br />• Extension of a 12 it water line from US highway 70 through Tinnin Road is possible but <br />will need to be reviewed more closely by the project engineer.
