b. The orientation program will cover both the resident's responsibilities and <br />Agent's responsibilities relating to the lease, rules and regulations and Property <br />policies, including lease termination and the transfer policy. Hands-on <br />instructions on the operation of appliances, fixtures and controls in a dwelling unit <br />will be provided by the Agent when the joint move-in inspection of the dwelling <br />unit is conducted. Resident will also be informed that the purpose of the move-in <br />inspection is to record the condition of the unit prior to occupancy for comparison <br />with a joint move-out inspection that occurs when a resident's lease is terminated <br />for any reason. <br />2.9 Rent Collection Policies and Procedures. <br />a. Rent payments will be made at the on-site office. Payments must be made in the <br />form of check or money order. Agent will encourage prepayment of rent. <br />b. Rent is due and payable on the first calendar day of the month. A late charge will <br />be assessed after the fifth {5th) day of any month in an amount determined by the <br />Agent. <br />c. Partial payment of rent will not be accepted unless prior written approval has been <br />given to the resident by the Property Manager. Approval must be based on good <br />and sufficient reason which is to be documented in the resident's file. A late <br />charge will not be assessed when such prior arrangement has been made. <br />d. Un the sixth (6th} day of the month, Agent will generate a delinquency report and <br />send individual letters notifying delinquent residents of the need to pay all <br />delinquent amounts immediately. The site staff will make personal calls to deal <br />with the delinquency. <br />e. A filing for rent and possession will be initiated in Magistrate's Court an the <br />eleventh {11th) day of the month in which the delinquency occurred. <br />2.10 Lease Enforcement. <br />a. Agent will ensure full compliance with the terms of the lease for all residents. All <br />provisions of the Lease will be explained thoroughly by Agent's site staff <br />members prior to the time the agreement is signed. Upon lease signing all <br />residents will pay a security deposit as established by Agent. <br />b. Agent will lawfully terminate any tenancy when, in Agent's reasonable judgment, <br />sufficient cause (including, but not limited to, nonpayment of rent) for such <br />termination occurs under the terms of the resident's lease. <br />Agent ma}~ consult with legal counsel to bring actions for eviction and to execute <br />notices to vacate and judicial pleadings incident to such actions; provided, <br />however, that the Agent shall keep the Owner informed of such actions and <br />follow such instructions as Owner may prescribe for the conduct of any such <br />action.
