d) History of criminal activity as defined in Paragraph 2.6(c}(2)(b) <br />above. <br />e) History of disruptive or destructive behavior. <br />f) Unacceptable credit history in the case of prospective residents <br />4. Mitigating Circumstances. <br />In the event of the receipt of unfavorable information with respect to an <br />applicant, consideration shall be given to the time, nature and extent of the <br />applicant's conduct and to factors which might indicate a reasonable <br />probability of satisfactory financial prospects or future suitable conduct. <br />For the Section 8 Project-Based Units, such consideration will be give to <br />the extent permitted by Section 8 project-based program rules and <br />regulations. Factors to be considered: <br />a} Negative credit information can be mitigated through third party <br />verification for each credit item that: (1) the applicant has entered <br />into a payment plan with creditor and there has been a three month <br />payment history; (2}there is a three month history of payment to <br />the creditor; or (3} applicant has disputed such debt and can <br />provide verification of such dispute. <br />b) Record of unsuitable rental history or behavior can be mitigated if <br />applicant can show that the reason for unsuitable behavior relates <br />to a disability in which the applicant can show evidence of <br />rehabilitation or participation in rehabilitation. If the evidence <br />relates to the change in a medical condition or course of treatment, <br />the Agent shall have the right to refer such information to persons <br />qualified to evaluate the evidence and verify the mitigating <br />circumstance, even if such information is of a medically <br />confidential nature. Such inquires will be limited to the <br />information necessary to verify the mitigating circumstance. If the <br />applicant refuses to provide further information, the Agent will <br />give no further consideration to the mitigating circumstance. <br />c} In the event of the receipt of unfavorable information with respect <br />to an applicant, consideration shall be given to the time, nature and <br />extent of the applicant's conduct and to factors which might <br />indicate a reasonable probability of favorable future conduct or <br />financial prospects. For example: (1}Evidence of rehabilitation; <br />(2) Evidence of the applicant family's participation in or <br />willingness to participate in social service or other appropriate <br />counseling service programs and the availability of such programs; <br />Agent will promptly notify rejected applicants in writing.
