5. Agent shall report apparent cases of applicant/resident fraud to the <br />Authority or appropriate government agency. It is the policy of the Agent <br />to cooperate with Federal, State, County or local authorities in prosecuting <br />cases which, in the Agent's reasonable judgment, appear to be willful or <br />deliberate misrepresentation. <br />2.4 Responsibilities of Agent. <br />Agent has entered into a Management Agreement with Owner and will be paid a fee for <br />ser<-•ices. That Agreement, as supplemented hereby, outlines the general responsibilities <br />of Agent as follows: <br />a. Agent will prepare an operating budget, set job standards and wage rates <br />previously approved by the Owner, investigate, hire, pay, supervise, and <br />discharge all property personnel necessary to properly maintain and operate the <br />property. <br />b. Agent will staff the property in accordance with the highest standards and <br />consistent with the Management Agreement and in compliance with the <br />governing documents. On-site staff shall include the positions indicated in <br />Subparagraph 2.S.b. of this Plan. <br />c. Agent will maintain the Property in a good, clean and safe condition at ail times <br />during the term of the Management Agreement. Maintenance items will include, <br />but not be limited to, exterior and interior cleaning, painting, decorating, <br />plumbing electrical, mechanical, carpentry, and other normal maintenance and <br />repair work necessary to maintain the property, the welfare of the residents or any <br />other person. <br />d. All maintenance requests from residents, or work orders initiated by management, <br />will be recorded and will become part of the resident's file and a work order <br />record system available for management review. Agent will make diligent efforts <br />to complete all emergency requests from residents within twenty-four (24) hours. <br />All work orders will be completed as soon as possible, but in no event mare than <br />twenty (20) days of receipt. <br />e. Agent will collect all rents due from residents and lessees and all monies due from <br />concessionaires and deposit them in proper accounts for the benef t of Owner. <br />f. Agent will maintain a list of prospective residents and will exercise diligent <br />efforts to renew all leases to responsible residents and attempt at all times to keep <br />the premises fully occupied. The selection of residents will be made in <br />accordance with the Resident Selection Plan outlined in Section 2.6. <br />g. Agent will maintain a comprehensive set of accounting records satisfactory to the <br />Owner and any regulatory agencies. These records will separately account for <br />payments received from occupants. Agent will maintain a separate bank account <br />under the name "Wellspring Village Operating Trust Account".
