-- Resident responsibility for all the unlawful or disturbing actions of their <br />households, guests or other persons under the Residents' control. <br />-- The screening of existing residents for criminal conduct as a part of each <br />recertification. <br />- The ready identification of nonresident individuals on development <br />property. <br />2.3 ReEationship Between Owner and Agent. <br />Owner has delegated to Agent the authority to manage the daily operation of the <br />Property. Agent will be charged with specific performance in accordance with <br />the Plan and will keep Owner and Authority informed on the operation of the <br />Property, by means of periodic budgets, financial statements, status reports and <br />monthly meetings. <br />b. Agent will comply with all budgetary procedures outlined in the Management <br />Agreement. The Management Agxeement sets forth the relationship between the <br />operating budget and Development Operating Subsidy payments made to the <br />Property. <br />c. Agent shall consider the misrepresentation of income or any other aspect of an <br />applicant's or resident's application or other housing related documents, to be a <br />serious lease and policy violation as well as a potential crime and shall take <br />appropriate action if fraud is discovered. Specifically: <br />Any applicant that has misrepresented income or family status shall be <br />declared ineligible for housing assistance and removed from the waiting <br />list for the site. <br />2. If an examination of a resident's file discloses that the resident made any <br />misrepresentations {at the time of admission or during any previous <br />reexamination) which resulted in the applicant/resident being classified <br />eligible when, in fact, the applicant/resident was ineligible, the resident <br />shall be required to vacate the apartment unit, even though the resident <br />may be currently eligible. <br />Any applicant that has made misrepresentations of income, transfer or <br />family status shall be subject to both eviction and being declared ineligible <br />for future housing assistance. <br />4. If it is determined that the resident's misrepresentations resulted in paying <br />a lower rent than should have been paid, the resident shall be required to <br />pay the difference between rent owed and the amount that should have <br />been paid. <br />
