request. <br />Chair Gordon asked staff to clarify who owns the right-of-way in question. She asked for <br />clarification about this proposed school site being separate from this request in terms of process. <br />Mr. DeBruhl stated that the contract had been signed for the school site. He further <br />explained that the entrance to the outer loop would not be at the southern entrance mentioned by Mr. <br />Johnson. That would be the entrance to the north. <br />Chair Gordon said she feels that there are many unanswered questions. She asked <br />Attorney Gledhill for guidance. <br />Attorney Gledhill indicated that staff could resolve the right-of-way ownership questions. <br />They could return with the answers to those questions at the same time that the Planning Board <br />returns with their recommendation. He felt that there was a linkage in this request between the school <br />location and whether or not to change the land use plan. However, they are not linked in any other <br />way. The Board of Commissioners might also request a copy of the contract in order to satisfy <br />themselves about that. The contract of sale to convey the land is signed. If the owner of the property <br />has agreed to give the property to the School Board the property will have to be conveyed by deed. <br />The school would have the ability to enforce that contract and force the sale. He does not have the <br />contract so he is not sure how that linked into the Land Use Plan Amendment request. <br />Chair Gordon asked Mr. Edwards to clarify his intent with regard to the school site. <br />Mr. Edwards indicated that his intent is to donate that site to the School Board and he also <br />believed that the school board's intent is to assist them in the rezoning of his property. He mentioned <br />that there is an advantage in their participation in sharing the cost of both the sewer and the road. <br />In response to a question from Commissioner Brown, Attorney Gledhill stated that the <br />Commissioners did not need answers to those questions in order to make a decision on the Land Use <br />Plan Amendment. The answers could be presented at the next meeting. The only connection is that <br />one of the criterion in making a change in the Land Use Element is apparently being presented as <br />being met because of the location of the school. <br />Staff was asked to answer the questions that have been raised during this discussion <br />when this item is brought back for Board consideration. <br />A motion was made by Commissioner Brown, seconded by Commissioner Halkiotis, to <br />refer the proposed amendment to the Planning Board for a recommendation to be returned to the <br />Board of Commissioners no sooner than May 4, 1999. <br />VOTE: UNANIMOUS <br />b) Bicycle Transportation Plan Component <br />This item was presented by Planner Slade McCalip for the purpose of receiving citizen <br />comment on a draft Comprehensive Plan Amendment for the update to the Transportation Element of <br />the Comprehensive Plan. He briefly reviewed some of the advantages of bicycle transportation, such <br />as a reduction in traffic congestion and noise and air pollution. There would also be a reduced need <br />for road maintenance as well as being a significant cost savings to the user. Bicycle transportation is <br />the most efficient, least polluting type of transportation that exists. During the Task Force's analysis <br />of the roads in Orange County they found that the roads are too narrow for cars by themselves. <br />When bicycles are added it becomes a danger to the cyclist and to a lesser degree to the driver. This <br />plan addresses that issue by defining priority routes so that cyclists can get around between the urban <br />Q:119990221d.c
