School, stated that many applications for rezoning in this area have been denied in the past and he <br />expressed surprise at this current request. He feels that additional commercial uses are not in <br />keeping with the Land Use Plan and that additional commercial uses were not, and should not be, <br />permissible under the current zoning. He mentioned that the Bingham TAC was not aware of this <br />application. He questioned whether there was an appropriate length of time for the notification. He <br />also commented that he did not receive a notice of this meeting. He asked the County Attorney to <br />respond to his question regarding length of time required for notification of a Public Hearing. He, and <br />each of the neighbors he spoke to, was strongly against this rezoning request. If the land use plan for <br />Bingham Township is to be changed, it needs to be evaluated and the public needs to be involved in <br />the process. He asked that this hearing be rescheduled or continued because of what he considered <br />to be a short amount of notification time. He was also concerned about the non-conforming nature of <br />this request and the potential impact on adjacent properties. <br />Virginia Leslie, a local homeowner and a member of the White Cross Small Area Work <br />Group, mentioned that she had only heard of this hearing yesterday. She disagreed with the <br />applicant's statement in the application that there was great community support for this request. On <br />the contrary, she mentioned that when she was a member of the White Cross Small Area Work Group <br />she distributed surveys to her neighbors. Their replies stressed their desire for a rural setting. They <br />did suggest cottage industry be allowed in existing commercially zoned areas. They also supported <br />wildlife corridors and park facilities. She feels that this area should be monitored by stringent planning <br />and zoning ordinances. She would like to see an opportunity for input from the community at-large <br />before any rezoning is considered. <br />Donald Wilson voiced his opposition to this rezoning request. <br />Jack Nestor, a homeowner in this area, felt that they were becoming a commercial area <br />against their will. He indicated that he is opposed to this request. <br />Tony Kane, a resident of Leslie Drive, mentioned that he found out about this rezoning <br />request through a flyer in his mailbox which was distributed by a neighbor. He spoke of his gratitude <br />for this community and for the thoughtful work of the County Commissioners. He said that he is <br />opposed to this rezoning request. <br />Mark Botts, a local resident, spoke in opposition to this request. He disagreed that the <br />residents in the White Cross area wants more commercial development. On April 27, 1998 the Small <br />Area Work Group met and expressed their concerns. At that meeting there was a strong sentiment <br />expressed against further commercial development. They understand that Mr. Leith may want to <br />develop his land in a particular way. However, it is currently zoned residential which is a profitable <br />use in Orange County. The White Cross Rural Community Node has reached the maximum of <br />commercial development allowed and should not be exceeded. <br />Robert Little, a local resident, spoke in opposition to this rezoning request. He mentioned <br />that it concerns him that no mention was made in the request of either the development in which he <br />resides or the one adjacent to his. The failure to mentioned the existence of their homes does not <br />speak well for the developer intentions. He urged the Board of Commissioners to deny this request. <br />K.B. Tripp, a local resident, spoke in opposition to this request. He asked that the Board of <br />Commissioners not approve this rezoning request. <br />Anita Solomon mentioned that she owns the property immediately south of Mr. Lieth's <br />property. She mentioned that two creeks meet on her property and then travel through Mr. Lieth's <br />property toward Highway 54. She does not oppose the rezoning of the area labeled NC-2 on the <br />Q:119990221d.c
