11 <br />County, Deed Book 1009, Page 437, N 81 ° 17'01" W, a distance of 23.19 feet to a point; <br />thence N 56°04'53"-W, a distance of 31.16 feet to a point in the southern right-of--way of <br />Homestead Road; thence along the southern right-of--way of Homestead Road S <br />79°52'48" E, a distance of 49.28 feet to the point and place of beginning containing 450 <br />square feet or 0.010 acre, more or less. <br />IT IS UNDERSTOOD AND AGREED BETWEEN GRANTOR AND GRANTEE: <br />1. Grantee, through the University and the University's employees, contractors and <br />agents, shall have the right to go in and upon Grantor's Properties to construct, install, <br />reconstruct, work upon, repair, alter, inspect, and in general do any other thing necessary to <br />construct, install, maintain and operate said LFG Equipment and Ductbank Equipment for the <br />purposes aforesaid. <br />2. Nothing in this Agreement is to be construed to diminish Grantee's existing. <br />license rights relating to the Landfill Property set forth in the LFG Agreement. The parties agree <br />that all terms and conditions in the LFG Agreement remain in full force and effect. <br />3. For the purpose of construction, installation, operation and maintenance of the <br />LFG Equipment and Ductbank Equipment, Grantee shall have the right of ingress to and egress <br />from the easement areas over the lands of Grantor adjacent to the easement areas and lying <br />between public or private roads and the easement areas in such manner as shall occasion the least <br />practicable damage and inconvenience to Grantor. <br />4. Grantee shall restore the easement areas after installation of the LFG Equipment <br />and Ductbank Equipment to approximately the same condition as before said installation, <br />ordinary wear and tear excepted; provided that Grantee shall not be required to replant trees or <br />shrubs removed during the construction of the LFG Equipment and Ductbank Equipment. <br />8 <br />{00042175.DOCX 3} <br />
