11 County, Deed Book 1009, Page 437, N 81 ° 17'01" W, a distance of 23.19 feet to a point; thence N 56°04'53"-W, a distance of 31.16 feet to a point in the southern right-of--way of Homestead Road; thence along the southern right-of--way of Homestead Road S 79°52'48" E, a distance of 49.28 feet to the point and place of beginning containing 450 square feet or 0.010 acre, more or less. IT IS UNDERSTOOD AND AGREED BETWEEN GRANTOR AND GRANTEE: 1. Grantee, through the University and the University's employees, contractors and agents, shall have the right to go in and upon Grantor's Properties to construct, install, reconstruct, work upon, repair, alter, inspect, and in general do any other thing necessary to construct, install, maintain and operate said LFG Equipment and Ductbank Equipment for the purposes aforesaid. 2. Nothing in this Agreement is to be construed to diminish Grantee's existing. license rights relating to the Landfill Property set forth in the LFG Agreement. The parties agree that all terms and conditions in the LFG Agreement remain in full force and effect. 3. For the purpose of construction, installation, operation and maintenance of the LFG Equipment and Ductbank Equipment, Grantee shall have the right of ingress to and egress from the easement areas over the lands of Grantor adjacent to the easement areas and lying between public or private roads and the easement areas in such manner as shall occasion the least practicable damage and inconvenience to Grantor. 4. Grantee shall restore the easement areas after installation of the LFG Equipment and Ductbank Equipment to approximately the same condition as before said installation, ordinary wear and tear excepted; provided that Grantee shall not be required to replant trees or shrubs removed during the construction of the LFG Equipment and Ductbank Equipment. 8 {00042175.DOCX 3}
