195 <br />Attachment 3 <br />(5~~E AND R~SP~~~E PAPER <br />The following document responds t®major themes Planning staff heard at the February ~~, ~a11 <br />E~uarterly Public Hearing regarding the UDU and written resolutions and cornrnents received on and <br />around this date. <br />~, C~ncer~a E he UDO is not sufficiently tied to the adopted Comprehensive Plan. <br />~~s~®ns~n The UD®is directly tied to the adapted Comprehensive and ether plans, such as the <br />faint Planning Area Agreement. The fallow'sng Sections of the UDd] directly ties together the Ud~ <br />and adapted plans: <br />~ Section x.1.7 Conformance with Ado ted Plans {page 1-3}requires that the UDD and proposed <br />amendments {which includes rezoning} be consistent with the goals and policies of the <br />Carnprehensive Flan andlor any specialized study approved by the Board of Commissioners. <br />~o C~u~cer~: The "floating zoning district" is a new construct far grange County and it refers to a <br />district that is net mapped until a rezoning application is approved. The new wording for the <br />conditional districts leaves out important text, which specifically ties any rezoning to compliance <br />with the underlying Comprehensive Plan, what is missing, for example, is language utilized for the <br />original Planned Development {PD}district that explicitly refers to protecting the character of the <br />surrounding neighborhoods and seeking opportunities for neighborhood scale mixed use. <br />~e~panseo Floating zoning districts are net a new concept for grange County as the Planned <br />Development districts are floating zoning districts; they just are not referenced as such in the <br />existing Zoning ordinance., The term "floating zoning districts" is a "planner-ese"term that appears <br />once in the UDC {on page 3,63 in Section 3.7.3 {A}{~.}}. If the term causes alarm, theterrn can be <br />removed and removal of the term will have no effect on the UDa, conditional zoning districts, or <br />how the districts function. <br />Conditional districts and any rezoning tv a conditional district fails under the provisions of Section <br />1.1.7 discussed in the response #1. Additionally, the followingsectians alsatie conditianaldistricts <br />to the adapted Comprehensive Plan: <br />~ Section 2,9.1E 2 {Review and Lvaluation of Conditional Use District} {page Z-4D}lists points to <br />be considered when evaluating an application. one point is consideration of the policies and <br />vb~ectives of the Comprehensive Plan. <br />~ Section 3.7 Conditional Districts {pages 3-6Z through 3-65}requires consistency with objectives <br />of the Comprehensive Plan and includes references to the Comprehensive Plan {3.7.x.{A}, <br />3.7.2~~), 3.7.4~A)) <br />The "Purpose" and "Applicability" sections farthe ~IPD-CZ {page 365}, MHP-CZ {page 3-67},and CU <br />{page 3-71}districts contain some of the language from the existing Planned Development text, <br />
