The scope of <br />.the Undertaking shall be-based upon the terms of the local business <br />plan then in effect. as developed and adopted by the Parties and <br />approved by the Secretary in accordance with N.C.G.S. ~122C-115.2. <br />3. DURATION OF AGREEMENT <br />This Agreement shall be in effect beginning on July 1, 2004 and <br />shall thereafter continue in effect concurrently with the timeframes <br />established in the local business plan adopted by the Parties. <br />Pursuant to N.C.G.S. ~122C-115.2, the duration of the local business <br />plan shall be at least three state fiscal years beginning July 1, <br />2004. <br />4. ESTABLISHMENT OF JOINT AGENCY <br />The counties hereby establish a joint agency known as the Orange <br />Person Chatham LME. ("LME"). The LME is charged with .all <br />responsibilities required for the exercise of the Undertaking. All of <br />the powers, duties, rights, functions and immunities of the Parties <br />necessary for the execution of the Undertaking are conferred upon the <br />LME. The delegation of authority to the LME shall empower the LME to <br />serve as the comprehensive planning, budgeting, implementing and <br />monitoring group for community-based mental health, developmental <br />disability and substance abuse services in Orange, Person and Chatham <br />Counties. <br />5. GOVERNING BOARD OF THE LME <br />The LME will be governed by a board of seven members one of whom <br />must be an elected county commissioner from Orange County, one of whom <br />must be an elected county commissioner from Person County, one of whom <br />• <br /> <br />•i <br />-6- <br />
