8 <br />Page 2 <br />Proposed Amendment <br />That the Agreement be clarified with the addition of the following language as a new <br />Subsection 3 to Section VILA (Emergency Water Transfers), and that said language <br />also be added to the existing text of Section VII.B (Non-Emergency Water Transfers): <br />"The provisions in this subsection do not apply to the treatment of and <br />transfer of water available through OWASA's, Hillsborough's, or Orange <br />County's Jordan Lake water supply storage allocations for use by OWASA, <br />Hillsborough, or Orange County customers. Nothing herein shall be <br />construed to prevent OWASA, Hillsborough, or Orange County from <br />entering into agreements as necessary to provide for water transfers to <br />afford OWASA, Hillsborough, or Orange County access to their respective <br />Jordan Lake allocation. " <br />Analysis <br />The WASMPBA is a product of the countywide interest in comprehensive water <br />resource management. As we have noted herein, our implementation strategy also <br />include a regional aspect and the request to amend the WASMPBA is consistent with <br />this plan. The amendment protects the long range planning strategy to develop <br />alternate yet contemplated methods to support our growth management strategy. Intra- <br />county as well as inter-county collaboration is scheduled to have greater relevance as <br />we examine water resources, public transit and air quality. The amendment is <br />consistent with the plans and policies of the local governments. <br />Recommendation <br />1n summary, the Planning Staffs of Orange County, Chapel Hill, Carrboro and <br />Hillsborough thought it prudent to support the amendment to the WASMPBA since this <br />agreement furthers our cooperative planning goals. <br />
