40 Non-emergency water transfers are only permitted with the approval of the Orange County Board of Commissioners and the elected or appointed boards of the service providers providing and/or receiving the transfer. If OWASA is the service provider, approval must come from the OWASA Board of Directors and the elected boards of Carrboro, Chapel Hill and Orange County. The provisions in this subsection do not apply to the treatment of and transfer of water available through OWASA's, Hillsborough's, or Orange County's .Jordan Lake water supply storage allocations for use by OWASA, Hillsborough, or Orange County customers. Nothing herein shall be construed to prevent OWASA, Hillsborough, or Orange County from entering into agreements as necessary to provide for water transfers to afford OWASA, Hillsborough, or Orange County access to their respective Jordan Lake allocation. C. In addition, this agreement and those listed below should all be read together. Where inconsistencies exist, this agreement shall. control, except as otherwise provided by law.
