~~r 9/9/~dy <br />7 <br />CONTRACT <br />This contract is made and entered into this 1St day of July, 2004, by Orange County, <br />North Carolina, a body politic and corporate, a political subdivision of the State of North <br />Carolina (hereafter "the County'), and the Chapel Hill-Carrboro City Board of Education, <br />a body corporate (hereafter "the Board of Education"). <br />WITNESSETH <br />Whereas, the County is member county of the Hyconeechee Regional Library, <br />Incorporated, and the operator of the Orange County Public Library (hereafter "the <br />Library"), which operates under Art. 14, Chapter 153A, of the North Carolina General <br />Statues to give library services to the residents of Orange County; and <br />Whereas, the Library operates to give library service to the residents throughout the <br />county and by this contract provides additional library service in southern Orange <br />County. <br />THEREFORE, IT IS AGREED THAT: <br />1. Term. The County and the Board of Education agree to enter into this Contract <br />for a period of one year beginning July 1, 2004. <br />2. Organization. The library located in the McDougle Middle/Elementary Schools is <br />a Branch of the Library (hereafter "the Carrboro Branch of the Library") and the Library <br />employees working there are employees of the County and report to the Library Director. <br />The Board of Education provides office space and utilities for the Carrboro Branch of the <br />Library. <br />3. Operation. The Carrboro Branch of the Library will be open to the general public <br />throughout the year for a maximum of twenty-six hours per week, said hours being 3:30 <br />pm to 8:00 pm Monday through Thursday, 10:00 am to 2:00 pm on Saturday and 1:00 pm <br />to 5:00 pm on Sunday. In no case will the Carrboro Branch of the Library operate during <br />school hours. Patrons of the Carrboro Branch of the Library will enter and exit only <br />through the main entrance of McDougle Middle School. When open to the public, the <br />policies and procedures of the Carrboro Branch of the Library, including selection of <br />materials, Internet use, and material challenges, will conform to the policies of the <br />Hyconeechee Regional Library, Incorporated. To supplement materials already owned, <br />the Carrboro Branch of the Library may borrow materials upon special request. The <br />County in its operation of the Carrboro Branch of the Library, agrees to undertake the <br />following responsibilities: <br />(a) The Carrboro Branch of the Library will assume all duties associated with <br />overdue materials from public patrons, including sending overdue notices. <br />
