ORANGE COUNTY
BOARD OF COMMISSIONERS
ACTION AGENDA ITEM ABSTRACT
Meeting Date: September 9, 2004
Action Agenda
Item No. -
SUBJECT: Smith Middle School Soccer Fields — Development and Joint Use Agreement
Amendment
DEPARTMENT: Recreation and Parks
ATTACHMENT(S):
2001 Development and
Joint Use Agreement
Amendment Summary Sheet
PUBLIC HEARING: (YIN) No
INFORMATION CONTACT:
Lori Taft, (919)
245 -2660
TELEPHONE NUMBERS:
Hillsborough
732 -8181
Chapel Hill
968 -4501
Durham
688 -7331
Mebane
336- 227 -2031
PURPOSE: To consider an amendment of the revised agreement to remove language
remaining and considered to be redundant given the proposed design of the field lighting
project.
BACKGROUND: On June 2, 2004, the Board approved amendments to the agreement
governing the use of the Smith Middle School Soccer Fields. The Carrboro Board of Aldermen
approved the same amendments on June 15, 2004. In moving forward with the project,
clarification has been made as to the preferred arrangement for control of the lights at the
fields. This electrical design will allow separate controls and metering of the two fields. The
proposed plan requires removal of one sentence in the agreement. The sentence in question
follows and is included in the attached summary sheet:
Page 6, paragraph 4. (a) last sentence (to be removed):
"The Board Of Education may use the light system, provided that the Board of
Education shall document its time of usage and, if the Board of Education uses
the light system for more than ten (10) hours per year, the Board of Education
shall contribute toward the annual maintenance and repair costs in proportion to
its use of the lights."
FINANCIAL IMPACT: None
RECOMMENDATION(S): The Manager recommends that the Board adopt the proposed
amendment to the agreement.
