ARTICLE 12 OTHER CONDITIONS OR SERVICES <br />(Insert descriptions of other services, identify Additional Services included within Basic Compensation and <br />modifications to the payment and compensation terms included in this Agreement.) <br />12.1 CONSTRUCTION PHASE - Administration of the Construction Contract: <br />During the construction phase of the work, the term "INSPECTION' shall be defined as follows: <br />"Inspection shall consist of visual observations of materials, equipment or construction work for the purpose <br />of ascertaining that the work is in substantial conformance with the Contract Documents and with the design <br />intent. Others shall not rely upon such inspection as acceptance of the work, nor should it be construed to <br />relieve the Contractor in any way from the obligations and responsibilities the Contractor assumes under <br />the construction contract. Specifically, but without limitation, inspection by the Design Professional shall <br />not require the Design Professional to assume responsibilities for the means and methods of construction, <br />nor for safety on the jobsite." <br />Add the following paragraph to Article 2.6.5: <br />Site visits shall be made weekly during the construction period and are included under Basic Services. If <br />additional trips are required for whatever reason, these trips shall be deemed as Additional Services and will <br />be billed at hourly rates (see 11.3.1). If the completion date of the project is extended, Additional Services <br />will be billed at hourly rates. <br />12.2. ITEMS NOT INCLUDED: <br />1. Approval processes or meetings other than the Orange County Site Plan approval, as noted in the attached <br />agreement letter. <br />2. Geotechnical testing and investigation <br />3. Legal fees <br />4. Topographic and boundary surveys <br />5.
