14. Liability and Standard of Care. CONTRACTOR shall perform <br />services for the COUNTY in a professional manner, using that <br />degree of care and skill ordinarily exercised by contractors <br />practicing in the same or similar locality as the project. The <br />total liability of CONTRACTOR whether in contract, tort <br />(including negligence, whether sole or concurrent), or otherwise <br />arising out of, connected with or resulting from the services <br />provided pursuant to this agreement shall not exceed the total <br />fees paid for the Work Order Agreement in question. The <br />CONTRACTOR hereby agrees to indemnify and hold harmless the <br />COUNTY, its departments and divisions, its employees and agents, <br />from any and all claims, liabilities, expenses or lawsuits caused <br />by the CONTRACTOR'S breach of contract or the negligent <br />performance by CONTRACTOR (or by any person acting for the <br />CONTRACTOR or for whom the CONTRACTOR is responsible). <br />CONTRACTOR will maintain the following minimum limits of <br />insurance during the term of this agreement: <br />1. General Liability <br />Each Occurrence: $1,000,000 <br />Fire Damage (Any one fire) $50,000 <br />Medical Expenses (Any one person) $5,000 <br />Personal & Adv Injury $1,000,000 <br />General Aggregate $2,000,000 <br />2. Automobile Liability - Combined Single Limit $1,000,000 <br />3. Worker's Compensation Statutory <br />Each Accident $100,000 <br />Each Disease - Each Employee$100,000 <br />Each Disease - Policy Limit $500,000 <br />15. Payments. COUNTY will make payments to the CONTRACTOR as <br />specified in this Contract .and in Addendum A at a total amount <br />not to exceed $215,000.
