By providing such references you agree that neither the County nor the clients referenced shall <br />have any liability regarding the provision of such references or the County's use of such <br />references in making selections under this request for proposal. <br />Orange County reserves the right to contact additional references discovered from its own <br />research, as necessary. <br />2.7 Proposed Fee. <br />The selected proposer will be paid a percentage of any monies recovered. Proposed fee must <br />include all costs associated with the performance of the services specified, including materials, <br />supervision, labor, insurance, transportation, delivery, fuel or other surcharges, demurrage and <br />any other related costs. Charges not listed in the RFP response will not be allowed. <br />2.8 Required Statements. <br />Include statements of assurance regarding the ability to fulfill the indemnification and insurance <br />requirements as listed in the Sample Agreement -Exhibit "B". Non-conflict of interest statement <br />and non-collusion statement as defined in the General Terms and Conditions (Section 7.0). <br />3.0 SUBMITTAL INSTRUCTIONS: <br />3.1 Submit one (1) original hardcopy (duplex on recycled paper) and four (4) copies in on a CD <br />in digital format (pdf) of your proposal no later than the time and date indicated on the cover <br />page of this RFP. All responses shall be submitted in a sealed envelope or container and clearly <br />marked with the RFP number and title on the outside of the parcel. <br />3.2 Proposal shall be submitted ONLY to: <br />Orange County <br />Asset Management & Purchasing Services <br />PO Box 8181 <br />131 W Margaret Lane, Suite 301 <br />Hillsborough, NC 27278 <br />3.3 Proposals submitted to a location other than the above will not be considered <br />duly delivered or timely. Orange County shall not be responsible for re- <br />routing proposals delivered to a person or location other that that specified above. <br />3.4 Faxed and/or e-mailed proposals shall not be accepted. <br />3.5 Late submittals shall not be accepted or considered. <br />3.6 All submittals, whether selected or rejected, shall become the property of <br />Orange County and will not be returned. <br />3.7 Orange County reserves the right to waive minor defects and/or irregularities <br />proposals, and shall be the sole judge of the materiality of any such defect or irregularity. <br />3.8 All costs associated with proposal preparation shall be borne by the offeror. <br />3.9 All proposals shall remain firm and fixed for a period of one hundred twenty <br />(120) days following the closing date for the receipt of submittals. <br />3.10 The deadline for submittine questions is August 18, 2010 at 5:00 p,m.
