(1) Apply those insurance proceeds to the cost of replacing the damaged <br />or destroyed Project property taken out of service, or <br />(2) Return to the Department an amount equal to the remaining State <br />interest in the damaged or destroyed Project property. <br />j. Transportation -Hazardous Materials. The Contractor agrees to comply with <br />applicable requirements of U.S. Pipeline and Hazardous Materials Safety Administration <br />regulations, "Shippers -General Requirements for Shipments and Packagings," 49 C.F.R. Part <br />173, in connection with the transportation of any hazardous materials. <br />k. Misused or Damaged Proiect Prooertv. If any damage to Project property <br />results from abuse or misuse occurring with the Contractor 's knowledge and consent, the <br />Contractor agrees to restore the Project property to its original condition or refund the value of <br />the State interest in that property, as the Department may require. <br />I. Responsibilities after Proiect Closeout. The Contractor agrees that Project <br />closeout by the Department will not change the Contractor's Project property management <br />responsibilities as stated in Section 14 of this Agreement, and as may be set forth in <br />subsequent Federal and State laws, regulations, and directives, except to the extent the <br />Department determines otherwise in writing. <br />Section 15. Insurance. In addition to other insurance requirements that may apply, the <br />Contractor agrees as follows: <br />a. Minimum Requirements. At a minimum, the Contractor agrees to comply with <br />the insurance requirements normally imposed by North Carolina State and local laws, <br />regulations, and ordinances, except to the extent that the Department determines otherwise in <br />writing. <br />b. Flood Hazards. To the extent applicable, the Contractor agrees to comply <br />with the flood insurance purchase provisions of Section 102(a) of the Flood Disaster Protection <br />07-SC-056 Page 46 of 59 <br />Orange County <br />
