~v <br />STATE OF NORTH CAROLINA NONURBANIZED AREA <br />COUNTY OF WAKE PUBLIC TRANSPORTATION <br />GRANT AGREEMENT FOR <br />' PUBLIC BODY ORGANIZATIONS <br />NORTH CAROLINA COMMUNITY TRANSPORTATION <br />DEPARTMENT OF TRANSPORTATION PROGRAM -SECTION 5311 <br />and CFDA NUMBER: 20.509 <br />ORANGE COUNTY PROJECT NUMBER: 11-CT-056 <br />THIS AGREEMENT made this the ~ay of ~'`~°~ , 20L~ (hereinafter referred to as <br />AGREEMENT) by and between the NORTH CAROLINA DEPARTMENT OF TRANSPORTATION <br />(hereinafter referred to as "Department", an agency of the State of North Carolina) and ORANGE <br />COUNTY, (acting in its capacity as the designated Section 5311 recipient hereinafter referred to as the <br />"Contractor"). <br />WHEREAS, Chapter 53 of 49 U.S.C. app 5311 et seq. (formerly Section 18 program) provides <br />federal administrative, operating, and capital assistance for public transportation in rural and small <br />urban areas by way of a formula grant program to be administered by the State; and <br />WHEREAS, the purpose of 49 U.S.C. 5311 is to enhance access of people in nonurbanized <br />areas for purposes such as health care, shopping, education, recreation, public services, and <br />employment by encouraging the maintenance, development, improvement, and use of public <br />passenger transportation systems; and <br />WHEREAS, the Contractor has been designated as the recipient of 49 U.S.C. 5311 funds, and <br />WHEREAS, Article 26 of Chapter 136 of the North Carolina General Statutes (N.C.G.S.) <br />designated the Department of Transportation as the agency of the State of North Carolina responsible <br />for administering all Federal and/or State programs relating to public transportation, and granted the <br />Department authority to do all things required under applicable Federal and/or State legislation to <br />properly administer the public transportation within the State of North Carolina; and <br />WHEREAS, the Governor of North Carolina, in accordance with Section 5311 of the Safe, <br />Accountable, Flexible, and Efficient Transportation Equity Act - A Legacy for Users (SAFETEA-LU), <br />Public Law 109-59, August 10, 2005, and the Transportation Equity Act for the 21St Century (TEA-21), <br />Public Law 105-178, June 1998, as amended, has designated the North Carolina Department of <br />Transportation as the agency to receive and administer Federal funds under this program; and <br />WHEREAS, in order to assist in providing transportation services, the Department, under the <br />terms of this Agreement shall make grants of administrative, operating and capital assistance to the <br />Contractor; and <br />WHEREAS, the Department and the Contractor desire to secure and utilize Section 5311 grant <br />funds and State funds for the above referenced purposes. <br />NOW, THEREFORE, in consideration of the mutual covenants herein set forth, the Department <br />and the Contractor agree as follows: . <br />Section 1. Purpose of Agreement. The purpose of this Agreement is to provide for the <br />undertaking of nonurbanized area public transportation services as described in the project application <br />(hereinafter referred to as "Project") properly prepared, endorsed, approved, and transmitted by the <br />Contractor to the Department, and to state the terms and conditions as to the manner in which the <br />Project will be undertaken and completed. <br />Section 2. Project Implementation. The Contractor shall carry out the Project as follows: <br />a. Scope of Project. Orange County (operating as Orange Public Transportation- <br />OPT) will continue providing community transportation services to human <br />service agencies and to the general public and connector service to Chapel <br />Hill Transit routes. <br />Updated 11 / 12/09 <br />
