2 <br />The Board of County Commissioners (BOCC) approved Woodlands Subdivision through <br />the major subdivision process on May 24, 2001 with Nine Gate Rd., Woodgate Dr., <br />Stonegate Dr., and Summergate Cr. designated as public roads. The subdivision roads <br />provide access for 25 homes: Nine Gate Rd. - 1, Woodgate Dr. - 6, Stonegate Dr. -14 and <br />Summergate Cr. - 4. The subdivision is located on the southern side of Jones Ferry Road. <br />As shown on the map in attachment 2a, Stonegate Drive and Summergate Circle were not <br />designed to allow future extension. In the case of Stonegate Drive, the road was not <br />stubbed out because there was an existing development with exempt and non-exempt lots <br />to the south of the Orange County line. In the case of Summergate Circle, Planning staff <br />had originally made a suggestion to stub out the road; however, it turned out that the <br />adjacent property is dedicated to be conveyed to the Triangle Land Conservancy and, as a <br />result, it will never be developed. The stub out requirement was deleted from the approval <br />conditions. <br />3 Efland Estates Subdivision (Gregg St.): Attachment 3a -Map <br />The requested road addition is about 0.018-mile long; the rest of the road is already on the <br />Secondary Road State Maintenance System. One house has an entrance to the section of <br />the road submitted for addition. The background research showed that Efland Estates <br />Subdivision was recorded in 1972. The County did not adopt subdivision regulations in the <br />Cheeks Township, where the subdivision was located, until 1978. As a result, this project <br />was not reviewed or approved by the County. However, a review of the plat showed that it <br />meets the policy adopted by the BOCC for recommending roads for addition to the State <br />Secondary Road Maintenance System: a) right-of-way (ROW) extends to the edge of the <br />property to provide connectivity; and b) irons have been set at the edge of ROW. <br />Conclusion <br />All above-referenced applications meet the criteria endorsed by the BOCC for <br />recommending acceptance of a public road into the State Maintained System for roads <br />approved through the governing jurisdiction's major subdivision process. <br />NCDOT has investigated these requests (please refer to Attachments 1 b, 2b and 3b), and <br />has submitted petitions to the BOCC for its review and recommendation. In accordance <br />with North Carolina General Statute §136-62', the Board is required to make a <br />recommendation regarding the petitions to the North Carolina Board of Transportation <br />(NCBOT) before the NCDOT can consider the petitions. <br />FINANCIAL IMPACT: There is no direct financial impact to the County associated with this <br />item. NCDOT will incur additional maintenance responsibilities and costs. <br />RECOMMENDATION(S): The Manager recommends the Board: <br />1. Forward the Petitions for Addition to the State Maintained System to the North <br />Carolina Department of Transportation for subdivision roads in: <br />` North Carolina General Statute §136-62 directs that "The citizens of the State shall have the right to <br />present petitions to the board of county commissioners, and through the board to the Department of <br />Transportation, concerning additions to the system and improvement of roads. The board of county <br />commissioners shall receive such petitions, forwarding them on to the Board of Transportation with their <br />recommendations." <br />
