• No provision of this Contract will be construed to pledge or to create a lien on any <br />class or source of the County's moneys (other than Net Proceeds and the funds and <br />accounts established pursuant to the Trust Agreement as may be provided in the Trust <br />Agreement), nor will any provision of this Contract restrict the County's future issuance <br />of any of its bonds or other obligations payable from any class or source of the County's <br />moneys (except to the extent this Contract, the Trust Agreement, the Deed of Trust and <br />the 2010 Bonds restrict the incurrence of additional obligations secured by the Mortgaged <br />Property). <br />To the extent of any conflict between this Article and any other provision of this <br />Contract, this Article will take priority. <br />ARTICLE XII <br />MISCELLANEOUS <br />12.1. County Accepts Trust Agreement Terms. The County accepts and <br />agrees to be bound by its responsibilities provided for under the Trust Agreement. <br />12.2. Notices. <br />• (a) Any communication provided for in this Contract must be in writing. <br />(b) Any communication under this Contract will be sufficiently given and <br />deemed given when delivered by hand or on the date shown as the delivery date on a <br />United States Postal Service certified mail receipt, or a delivery receipt from a national <br />commercial package delivery service, if addressed as follows: <br />(i) if to the County, to Orange County Manager, Attention: Notice <br />under 2010 LOBS Financing Contract, Post Office Box 8181, Hillsborough, <br />North Carolina 27278. <br />(ii) if to the Company, to Orange County Public Facilities Company, <br />Attention: Notice under 2010 LOBS Financing Contract, c/o Orange County <br />Manager, Post Office Box 8181, Hillsborough, North Carolina 27278. <br />(iii) if to the Trustee, to The Bank of New York Mellon Trust <br />Company, N.A., <br />(c) Any communication sent under this Contract to the Company must also be <br />sent to the County and the Trustee. <br />• (d) Any addressee may designate additional or different addresses for <br />communications by notice given under this Section to each of the others. <br />19 <br />
