3 <br />Having an /nterlocal Agreement in place that covers these issues is important prior to the <br />opening of the. park. The draft was also considered by the Town Board of <br />Commissioners, which discussed it on October 77 and again on October 25. The Town <br />Board has approved a revised version that deletes some provisions: <br />• Section 2.a (the Town's $30,000 annual contribution to operating expenses); <br />• Section 3.b (Town police coordinated public safety response); and <br />• Section 4 (Periodic consideration of annexation of the park). <br />FINANCIAL IMPACT: The October 5th version of the (nterlocal Agreement included a Town <br />contribution of $30,000 toward the operating costs of the park, increasing by 2% annually <br />beginning in July 2011. The Town Board's October 25 revision of the Agreement strikes this <br />provision and would commit no funding to park operations, other than absorbing water and <br />sewer costs and providing for trash pickup. The Town's adopted FY 2010-11 Operating Budget <br />included $30,000 labeled "Fairview Park O&M Costs." <br />The County will incur operating expenses associated with this facility. Operation of the park will <br />be handled initially by the DEAPR budget and existing staff. Some necessary equipment, <br />estimated in the $18-20,000 range, will be purchased using existing funds. Staff notes that, <br />without the planned Town funding and likely County funding constraints, park operations <br />and staffing will be affected and will require a decreased level of service. The October <br />25th version of the Agreement did retain the Town's absorption of the cost of water and sewer to <br />the park, as well as park gate closure (the gate was requested by Town Police). Not covered in <br />the Agreement is an informal arrangement that will have trash pickup to be bagged and placed <br />in a proximate location by the County, and then picked up by the Town. <br />RECOMMENDATION(S): The Manager recommends that the Board consider the changes <br />made by the Town Board of Commissioners (in the attached October 25th revised Agreement) <br />and provide direction to the Manager, Attorney and staff. Without a formal agreement and the <br />transfer of land between the Town and County in place, it would not be advisable to open the <br />park for public use. <br />
