<br />Individual Development Accounts Program <br />State CDBG Regulations <br />1. Citizen Participation <br />If funded, grantee will have documentation on file of compliance with citizen <br />participation requirements in the application process 4 NCAC 19L.1002(b): <br />publisher's affidavits of notices for and minutes signed by the town or county clerk <br />of the two required public hearings. <br />2. Administration of Project <br />If funded, grantee will meet minimal levels of supervision in implementing the <br />project as follows: <br />a. At least two persons from the local government will review invoices and <br />requests for payment. <br />b. The local government manager reviews and signs off on all project reports. <br />c. All project files will be maintained at the local government offices and made <br />available to citizens during regular business hours. <br />3. Audits/Compliance <br />CDBG grantees expending $25,000 or more in a fiscal year are required to have <br />funds audited for the CDBG program. CDBG funds can be used to pay for the <br />CDBG portion of the audit provided the grantee has expended $300,000 or more in <br />the fiscal year in total federal awards (CDBG and other federal funds). If the <br />grantee has expended less than $300,000 in total federal awards, the grantee may <br />budget local funds in the administrative line item in the CDBG application to pay <br />for the CDBG portion of the audit and claim the local administrative funds as local <br />commitment. <br />4. Housing (When using CDBG funds for housing activities.) <br />If funded, grantee will adhere to the following: <br />a. Consider the state's recommendation to adopt a minimum housing code or <br />redevelopment plan or to utilize owner agreements or eminent domain provisions <br />to promote owner participation for rehabilitation activities in a concentrated needs <br />project area. <br />b. Establish home maintenance procedures (written or oral) to instruct occupants <br />of houses, including (1) maintenance of any on-site wastewater systems and/or <br />wells or (2) maintenance of newly installed indoor plumbing. <br />c. Establish a written recipient referral procedure to address non-CDBG needs (i.e. <br />social services, credit counseling, employment, etc.). <br />d. Work with the local health department to comply with federal and state lead- <br />basedpaint requirements. <br />e. Inspect houses in accordance with North Carolina Division of Community <br />Assistance Housing Rehabilitation Standards and Volume VII-Residential of the <br />North Carolina State Building Code. <br />f. If abandoning outhouses or septic tanks, budget adequate funds to cover related <br />costs in accordance with local health department regulations. <br />20 <br />
