<br />~~~' ,~li Z~~~~ <br />5 ~' <br />NORTH CAROLINA <br />ORANGE COUNTY <br />NORTH CAROLINA DEPARTMENT OF MAY 16, 2005 <br />TRANSPORTATION <br />AND <br />COUNTY OF ORANGE <br />ENHANCEMENT AGREEMENT <br />PROJECT E-4779 <br />W BS Element: 36469.1 <br />CFDA 20.205 <br />THIS AGREEMENT, made and entered into this the ~_ day of , 2005, <br />between the DEPARTMENT OF TRANSPORTATION, an agency of the State of North <br />Carolina,. hereinafter referred to as the Department, and ORANGE COUNTY, NORTH <br />CAROLINA, hereinafter referred to as the County; <br />WITNESSETH: <br />WHEREAS, Section 1201 of the Transportation Equity Act for the 21St Century <br />(TEA-21) requires that Surface Transportation Program funds be available for transportation <br />enhancement activities and allows for the acquisition of scenic easements on sites adjacent to, <br />or in close proximity to, a transportation facility, which possesses significant aesthetic, <br />historical, natural, visual or open space values; and, <br />WHEREAS, the County has identified the St. Mary's Road Corridor, SR 1002, a historic <br />corridor on the National Register of Historic Places Study List, as a transportation facility that <br />possesses significant aesthetic, historic, natural, visual or open space values; and, <br />WHEREAS, the Department, desiring to protect unique and valuable viewsheds along <br />the St. Mary's Road Corridor, has programmed federal Enhancement Funds for the purchase of <br />scenic conservation easements; and, <br />WHEREAS, the County has encouraged the Department to preserve the viewshed of <br />one or more of the priority tracts of land identified in the County's enhancement application to <br />preserve scenic beauty and rural character along the St. Mary's Road Corridor in Orange <br />County; and, <br />-1- <br />
