~~~ <br />STATE OF NORTH CAROLINA <br />THE COUNTY OF ORANGE <br />AGREEMENT FOR ENGINEERING <br />CONSULTANT SERVICES <br />This Agreement made and entered into this the e2~ day of ~r ~r , 2005, by and between Orange <br />County, on behalf of its Solid Waste Department, herein referred to as the "County" and Phillip Post & Associates, <br />Inc., 401 Providence Road, Suite 200, Chapel Hill, North Carolina 27514, herein referred to "Engineering <br />Consultant" for the design, permitting, engineering and other related services for the construction, in a fiscally <br />responsible manner, of a high quality, structurally sound, safe and effective gravity sanitary sewer system for the <br />Orange County Landfill (hereafter the "sewer system") which shall be used to convey leachate from the lined <br />landfill, and sanitary sewage from the new Solid Waste Operations Center located on Eubanks Road, to a new sewer <br />line to be constructed on Millhouse Road by the Town of Chapel Hill. A preliminary site plan of the sewer system <br />dated May 10, 2005 is attached and incorporated herein as Exhibit A. <br />I. PROJECT DESCRIPTION <br />Currently leachate is collected from the 26-acre lined landfill located on the south side of Eubanks Road and <br />stored in a lined containment pond. The leachate is periodically pumped into a 3,500-gallon tank truck and is <br />transported to a manhole located in the Chapel Hill Public Works Operations Center where it is discharged into the <br />sewer. The truck driver fills a sample bottle for each load discharged into the sewer, which bottles are then delivered <br />to the Mason Farm Wastewater Treatment Facility at the end of each day. <br />On or about January 2007, the Public Works Operations Center on Martin Luther King Boulevard will be <br />moving to a new facility on Millhouse Road, at which time landfill staff will be required to transport the leachate to <br />the Mason Farm Wastewater Treatment Facility. The Solid Waste Operations Center will also be relocated in the <br />spring of 2007. The sanitary waste from the Solid Waste Operations Center will also be conveyed by the proposed <br />sewer system along Eubanks Road to a manhole about 2,000 feet east of the Operations Center <br />The sewer system project will consist of the design, pemutting, engineering and other related services as <br />specified below for the construction of a gravity sanitary sewer system from the new manhole located at the <br />intersection of Eubanks Road and Millhouse Road and extending west to serve the new Solid Waste Operations <br />Center and to receive the leachate now being held in the leachate containment pond. The sewage in the sewer <br />system will flow northeast toward Eubanks Road. It is expected that it will continue east along the Eubanks Road <br />right of way to a point west of the railroad tracks. The sewer system will then cross under Eubanks Road, the <br />raikoad and Millhouse Road. <br />WITNESSETH that for and in consideration of the mutual promises and conditions set forth below the <br />County and the Engineering Consultant agree as follows: <br />II. DUTY OF ENGINEERING CONSULTANT: <br />The Engineering Consultant agrees to provide the services described in the Project Description above and the <br />Scope of Basis Services specified below in Article III of this Agreement. <br />III. SCOPE OF BASIC SERVICES: <br />A. DESIGN PHASE: <br />1. Prepare detailed plans/profile drawings of all sanitary sewer system collection piping and all <br />necessary miscellaneous details. <br />2. Prepare detailed technical specifications, permit applications and encroachment agreements, and <br />consult with Orange Water and Sewer Authority (OWASA) as necessary to accomplish this. <br />3.
