1 <br /> ORANGE COUNTY <br /> BOARD OF COMMISSIONERS <br /> ACTION AGENDA ITEM ABSTRACT <br /> Meeting Date: October 19, 2010 <br /> Action Agenda <br /> Item No. H -e,_ <br /> SUBJECT: Orange Unified Transportation Board - Removal of Member <br /> DEPARTMENT: Board of Commissioners PUBLIC HEARING: (Y/N) No <br /> ATTACHMENT(S): Under Separate Cover INFORMATION CONTACT: <br /> Membership Roster Clerk's Office, 245-2130 <br /> Letter of Notification - Removal <br /> Attendance Records <br /> Letters From Advisory Board Member <br /> PURPOSE: To consider removing one member from the Orange Unified Transportation Board. <br /> BACKGROUND: Paragraph 7 of Orange County's Resolution regarding Orange County Appointment <br /> And Orientation Process for Boards and Commissions states that: <br /> If an appointee, in any calendar year, has absences which constitute more than 25 percent of the <br /> regularly-scheduled Board meetings or three consecutive meetings,whichever comes first,which <br /> he or she is required to attend, he or she is obligated to resign...If the individual refuses to resign, he <br /> or she may be removed by action of the Board of county Commissioners subject to state or local law. <br /> The OUT Board support staff notified the Clerk's Office that one member, Mr. Eric B. Tillman, <br /> member at-large, last attended a meeting of this Board in May, 2009. A letter (asking for his <br /> resignation) was sent on July 28, 2010. There was no response from him. Mr. Tillman was <br /> contacted by telephone by the Clerk's Office and "stated that he was busy at that time, but <br /> wanted to discuss this board and his concerns. He asked if someone would call him later. He <br /> was then contacted the second time by telephone and said he would not submit his resignation. <br /> When advised that the next step for us was to ask the Board to remove him, he said that would <br /> fine and that he would respond to this removal in writing after this occurred because he felt that <br /> the Board of Commissioners needed to hear what he had to say about his concerns with the <br /> OUT Board. <br /> FINANCIAL IMPACT: None. <br /> RECOMMENDATION(S): Consider removing Mr. Tillman from the Orange Unified <br /> Transportation Board in order to appoint another applicant. <br />
