13 <br />7.7 Liability. CONSULTANT'S total liability to the CLIENT <br />for any and all injuries, claims, losses, expenses, damages, <br />or claim expenses arising out of this Agreement from any cause <br />or causes shall be the sum of $50,000, or the total amounts <br />payable to CONSULTANT for Basic Services and Optional Services <br />under this Agreement, whichever is greater. Such causes <br />include but are not limited to the CONSULTANT'S negligent <br />acts, errors or omissions, strict liability, breach of <br />contract or breach of warranty (expressed or implied). <br />7.8 Professional Practices. CONSULTANT shall render services <br />under this Agreement in accordance with the generally accepted <br />professional practices for the intended use of the Project, <br />and makes no guarantee, either express or implied. <br />7.9 Integration. This Agreement, including Appendix I, <br />represents the entire and integrated agreement between the <br />CLIENT and the CONSULTANT and supersedes all prior <br />negotiations, representations or agreements, either written or <br />oral. This Agreement may be amended only by written <br />instrument signed by both the CLIENT and CONSULTANT. <br />7.10 Severability. In the event any provisions of this <br />Agreement shall be held to be invalid and unenforceable, the <br />remaining provisions shall be valid and binding upon the <br />parties. <br />7.11 Execution and Acceptance.
