contracts by virtue of 29 CFR 5. 12(a)(1) or to <br />participate in HITD programs pursuant to 24 CFR Part 24 <br />or, if applicable, by virtue of Section 3(s) of the <br />Davis-Bacon Act. No part of this contract shall be <br />subcontracted to any person or firm ineligible for award <br />of a Government contract by virtue of 29 CFR 5. 12(1)(1) <br />or to participate in HUD programs pursuant to 24 CFR <br />Part 24, or, if applicable, by virtue of Section 3(a) of <br />the Davis-Bacon Act. <br />The penalty for making false statements is prescribed in <br />the U.S. Criminal Code, 18 U.S.C. 1001 and 18 U.S.C. <br />1010. <br />13. Debarred and Suspended Parties <br />13.1 The COUNTY and Contractor must not make any award <br />or permit any award (subgrant or contract) at any time <br />to any party which is debarred or suspended or is <br />otherwise excluded from or ineligible for participation <br />in Federal assistance programs under Executive Order <br />12549, "Debarment and Suspension". By entering into this <br />contract, the Contractor certifies that it is not <br />currently debarred or suspended, or is otherwise <br />excluded from or ineligible for participation in Federal <br />assistance programs under Executive Order 12549, <br />"Debarment and Suspensions". <br />14. Disputes, Default, and Termination <br />14.1 Disputes. In the event of dispute arising under <br />this Contract, the Contractor shall notify the COUNTY <br />promptly in writing of their contentions and submit the <br />claim. If the dispute arises before performance of the <br />related work, the written notice shall be submitted <br />prior to commencing such work. In any event, the <br />Contractor shall proceed with such work in compliance <br />with the instructions of the COUNTY; such compliance <br />shall not be a waiver of the Contractor's rights to make <br />a claim, provided they have notified the COUNTY in <br />writing as above stipulated. <br />14.2. Default and Remedies. <br />Default shall consist of any failure by the Contractor <br />to perform under this contract or written amendments <br />thereto or any breach of any covenant, agreement, <br />19 <br />
