18 <br />EXHIBIT A <br />RECOMMENDED FINDINGS OF THE ORANGE COUNTY PLANNING BOARD & PLANNING STAFF <br />PERTAINING TO <br />PIEDMONT ELECTRIC MEMBERS CORPORATION'S SPECIAL USE PERMIT APPLICATION <br />2500 NC Highway 86 South <br />Special Uses must comply with general and specific standards as set forth in Article 8. Article 8.2.1 b) requires written findings <br />certifying compliance with the following: <br />(1) Specific regulations governing individual Special Uses as set forth in Article 8.8. These regulations are <br />divided into two (2) sections, which include: <br />(a) Application components; and <br />(b) Specific standards for Special Uses (Article 8.2.4, Article 8.8.17.1 and 8.8.17.2). <br />(2) Other requirements as set forth in the Zoning Ordinance, including the provisions of Article 5 (Dimensional <br />Requirements) and Article 6 (Application of Dimensional Requirements). <br />Listed below are the findings of the Orange County Planning Board and Planning Staff regarding the pending application. The <br />findings have been presented by Article and requirement to assist the Board in its deliberations. <br />ARTICLE 8.2.1 & 8.2.2 - APPLICATION COMPONENTS <br />("Will" indicates compliance, "Will Not" indicates non - compliance <br />Ordinance Reauirements <br />In accordance with Article 8.2.1 <br />and 8.2.2 of the Zoning <br />Ordinance, the Board of <br />Adjustment shall also consider <br />the following general conditions <br />before the application for a <br />Special Use can be approved: <br />Article 8.2.1 <br />1. The use will maintain or <br />promote the public health, safety <br />and general welfare, if located <br />where proposed and developed <br />and operated according to the <br />plan as submitted. <br />2. The use will maintain or <br />enhance the value of contiguous <br />property (unless the use is a <br />public necessity, in which case <br />the use need not maintain or <br />enhance the value of contiguous <br />property). <br />PLANNING BOARD /STAFF <br />RECOMMENDED <br />FINDINGS <br />_X Will _ Will Not <br />X Will _ Will Not <br />EVIDENCE SUBMITTED <br />TO SUPPORT FINDINGS <br />The applicant believes the <br />replacement tower, in the <br />same general location as the <br />existing tower will promote the <br />public health, safety, and <br />general welfare be enhancing <br />emergency communications <br />within the community, <br />particularly during catastrophic <br />conditions. <br />Applicant has submitted <br />evidence for consideration <br />documenting those values of <br />contiguous properties will be <br />maintained or enhanced. <br />According to information <br />submitted, the tower will not <br />have impact on the availability <br />or affordability.
