U ~ c~ - 200 ~ - off/ <br />~- /a- - ~"p° ~ ~ <br />~JJ ATTAC ENT 3 <br />National Pollutant Discharge Elimination System (NPDES) Program <br />Grant Project Ordinance <br />Be it ordained by the Orange County Board of County Commissioners that pursuant to Section 13.2 of <br />Chapter 159 of the General Statutes of North Carolina, the following grant project is hereby adopted. <br />Section 1. The project authorized is the .National Pollutant Discharge Elimination System (NPDES) <br />Program. Under Phase II of this stormwater program, the Town of Hillsborough is <br />required to develop, implement, and enforce a stormwater program designed to reduce <br />the discharge of pollutants from the Town's Municipal Separate Storm Sewer System to <br />the maximum extent practical. Through an approved Memorandum of Agreement <br />(MOA) between the Town of Hillsborough and Orange County, the County's Erosion <br />Control Division within the Planning and Inspections Department will implement this <br />program on behalf of the Town. The Town will reimburse the County for all costs <br />associated with human resources, operating and capital expenses that might occur <br />during the implementation of this program. <br />Section 2. The officers of the County are hereby .directed to proceed with the grant project within <br />the grant document and the rules and regulations of the grantors. <br />Section 3. The following revenue is anticipated to be available during the first two years of this <br />five-year project: <br />Intergovernmental (Year l) -Town of Hillsborough $18,500 <br />Intergovernmental (Year 2) -Town of Hillsborough $57,800 <br />Total Revenue $76,300 <br />Section 4. There is no required County match for this grant. <br />Section 5.. The following amount is appropriated for this project: <br />Community & Environment -NPDES Grant $76,300 <br />Section 6. The finance officer is hereby directed to maintain within the grant project sufficient <br />specific detailed accounting records to provide the accounting to the grantor agency <br />required by the grant agreement and federal and state regulations. <br />Section 7. Funds may be advanced from the general fund for the purpose of making payments due. <br />Reimbursement requests should be made to the grantor agency in an orderly and timely <br />manner. <br />Section 8. Copies of this grant project ordinance shall be made available to the finance officer for <br />direction in carrying out this project. <br />Section 9. There are no positions authorized through this grant project ordinance. <br />Section 10. This project ordinance is in effect until September 30, 2007. <br />Adopted this 12th day of September 2006. <br />
