i <br />r' '-i <br />.'~_~ <br />times during installation of the distribution lateral lines. <br />(8) Due to the design capacity of the wastewater disposal system, the total number' <br />of bedrooms permitted for the 14 lots shall be 42, three bedrooms per lot. - - <br />This limitation shall be included in the restrictive covenants for McLennan's <br />Farm. <br />(9) Low flush (1.5 gallons per flush) toilets shall be required for use in all <br />residential units. <br />(10) Each lot owner shall be responsible for a pro-rata share of the cost of <br />operation, maintenance and repair of the community wastewater disposal system <br />and nitrification fields which responsibility shall be a covenant running with <br />the land and be documented in the restrictive covenants for McLennan's Farm. <br />(11) No portion of the proposed jogging trails shall be located within the proposed <br />nitrification field. In addition, a 15-foot pedestrian access easement shall <br />be provided from the right-of-way of McLennan's Farm Road to the jogging trail. <br />(12) A fence shall be provided around the nitrification field and repair area to <br />limit vehicular and pedestrian access and prevent compaction of soils. The <br />location o£ the nitrification field with respect to the intermittent stream <br />shall be denoted on the plan. Excepting those structures used to house <br />facilities associated with the sewage disposal system, no other permanent <br />structures shall be built on the nitrification fields or on the designated <br />reserve area. <br />(13) Before a Special Use Permit is issued and before Orange County will consider <br />for approval the final subdivision plat, documents pertaining to the creation <br />and operation of restrictive covenants and a homeowners association must be <br />submitted to and approved by the County Attorney. The documents shall identify <br />all improvements which will be owned by and/or will be the responsibility of <br />the homeowners association to operate and maintain, including the estimated <br />annual cost for same. In addition to improvements, all permanent devices <br />installed for the purpose of erosion control shall also be the responsibility <br />of the homeowners association. <br />(14) 30-foot drainage easements (15 feet each side of stream) must be shown on the <br />site plan and erosion control plan on Lots 10 and 13 adjacent to the <br />intermittent stream and spring. The water level of the existing pond on Lot 6 <br />must also be designated on these plans. <br />(15) Tree protection areas must be delineated on the plan as required by Section <br />IV-B-8-c-y of the Subdivision Regulations. Proposed street trees must be <br />located a minimum of 15 feet from the edge of the 12-foot utility easement. <br />(16) Construction plans for McLennan's Farm Road and George Poe Road, approved by <br />the N.G. Department of Transportation and including stormwater culvert sizes <br />and hydraulic calculations, must be submitted to the Planning and Inspections <br />Department. <br />(17) Property lines are to follow the sight triangles_at Bowden Road (SR 1946). <br />(18) Additional right-of-way is to be dedicated at the entrance island to <br />
