<br />~.-,w . <br />_ MELVA OKUN asked that the Commissioners be both courageous and forward thinking <br />when they vote on McLennan's Farm. The basic issue is clear and that is whether they,. , <br />will vote to pratect and promote the public health and welfare. The OWASA Watershed _ .. <br />Study has shown that even with development density of one unit per five acres there will <br />still be some degrading of the water, if development is allowed at one unit per 2-1/2 <br />acres that will significantly contribute to the lowering of the quality of the water <br />that citizens presently enjoy. She made reference to the Faxfax County decision to <br />pratect the watershed. She asked that the Commissioners deny the McLennan Farm permit <br />and to move toward a moritarium on development in the watershed until they decide how to <br />implement the long awaited results of the watershed study. <br />LIV LUDINGTON stated she feels strongly that the recommendations in the <br />University Lake Watershed Study need to be followed. She expressed concern for public <br />health, safety and welfare. She does not want the work that has been done in the OWASA <br />study, and the water quality, to be undermined by the Commissioners allowing McLennan's <br />Farm to be approved. She entered a copy of the Camp Dresser and McKee report into the <br />public record. This is on file in the Commissioners' Library. <br />Chairman Carey noted that two decisions will be made tonight: (1) consider the <br />McLennan's Farm proposal on its merit based on the current ordinance and (2) deal with <br />whether the County will pursue any interim development standards. <br />Discussion ensued by the Commissioners on the protection of the public health, <br />safety and welfare and the fairness and equity issues that should be considered in the <br />decision to approve/or not approve of this development. <br />Motion was made by Chairman Gorey, seconded by ,Commissioner Marshall that <br />whereas evidence indicates compliance with the general standards, specific rules <br />governing the specific use, and that the use complies with all required regulations and <br />standards, the application was found to (1) promote the public health, safety, and <br />general welfare if located where proposed and developed and operated according to the <br />plan as submitted, (2) maintain or enhance the value of contiguous property and (3) be <br />in compliance with the general plan for the physical development of the county as <br />embodied in the regulations or in the comprehensive plan, .or portion thereof, adopted by <br />the Orange County Board of Commissioners, approval is hereby given for a Class A Special <br />Use Permit, rezoning of the property from RB to PD-H-RB and the preliminary subdivision <br />plat for McLennan's Farm making the findings as recommended by the Planning Board with <br />the 36 conditions as recommended by the Planning Board and amended by the Administration <br />as listed below: <br />(l) The grantee of this Special Use Permit shall post with Orange County, in a form <br />acceptable to the County Attorney, a bond or lettez of credit in an amount <br />equal to the cost of all improvements plus ten percent (10$). The amount shall <br />be determined on the basis of fully executed construction contracts or <br />.certification by a registered engineer employed by the grantee of this Special <br />Use Permit. As improvements axe completed a corresponding amount of money may <br />be released Exam the security instruments or the security instruments may be <br />re-negotiated based on the "yet to do" portion of the improvements. <br />(2) The plans and specifications for the design and construction of the system for <br />wastewater disposal shall be approved by Orange County and the Orange County <br />Health Department. <br />(3) The wastewater disposal system and nitrification fields shall be operated by <br />Orange County, a municipality, a public water and sewer authority or a State <br />
