i <br />than 11.5 acres each, She asked if they will be able to build homes and if they are <br />burned out will they be able to rebuild? <br />Collins indicated that the 11.5. acre minimum was for the PID-I and PID-II <br />districts themselves, not for adjoining property. They would be able to rebuild, if <br />that was necessary. Tingley said that she and her siblings are totally against the <br />buffer zone, <br />Richard Calder, speaking for his in-laws Myrtle and Floyd Boyce who own land <br />surrounded by Duke Forrest, agreed with Mr. Wallace's suggestion of looking at the <br />boundaries of the forest and protecting the watersheds by using existing zoning laws. <br />He opposed the 100 foot buffer. Duke Forest land is private land and this zoning <br />applies with a certain time limit to it. Duke could come in and ask to develop its <br />land into 5 acre plots. The five acre plots could build on the line and use the 100 <br />foot buffer on his parents side to protect their land. This seems wrong to him. <br />Spence Dickinson spoke in opposition to the buffer, He asked if the County could <br />legally take this property and what the lawyers' position is on this. <br />County Attorney Geoffrey Gledhill stated that he did not have a position at this <br />time. He indicated that he would review all the information and give the <br />Commissioners an answer. <br />Dickinson also asked to have the intent of this buffer explained to him. His <br />initial understanding of the reason for the PID designation was to force Duke to go to <br />a Public Hearing if they wanted to do anything other than research, Now it appears <br />that with the PID-II designation they would be able to do many different things with <br />their land, <br />Chairman Carey indicated that the intent mentioned above has not changed, <br />Sam Wilburn spoke in opposition to the buffer. <br />Chairman Carey entered into the record a letter from Mr. Wayne Jones, Acting <br />Vice-Chancellor for Business and Finance at the University. The letter indicates that <br />the University is not in opposition to this, however, the portion of that area <br />referred to as the Parker property is not a part of the biological reserve. This land <br />lies within the Town of Chapel Hill R-l zoning jurisdiction. They request that the <br />Parker property also be zoned R-1. This letter is in the permanent agenda file in the <br />Clerk's office and is made a part of these minutes by reference. <br />THE PU$LIC HEARING WAS CLOSED <br />A motion was made by Commissioner Hartwell, seconded by Chairman Carey, to refer <br />this item to the Planning Board for a recommendation to be brought back to the <br />Commissioners no sooner than April 3rd. <br />VOTE: UNANIMOUS <br />(4) Article 6.16 - Buffer Requirements Adjacent to Public Interest Districts <br />b.
