~~s -~d~~ ~ o ~ ~ <br />ORANGE COUNTY BOARD OF COMMISSIONERS RESOLUTION TO AMEND <br />INTERLOCAL COOPERATION AGREEMENT TO ALLOW IMMEDIATE <br />SUSPENSION AtVD RESOLUTION TO SUSPEND INTERLOCAL <br />COOPERATION AGREEMENT BY MUTUAL CONSENT OF THE PARTIES <br />WHEREAS, Orange, Person, and Chatham counties entered into an Interlocal <br />Cooperation Agreement for the Provision of Mental Health, Developmental <br />Disabilities and Substance Abuse Services effective July 1, 2004; and <br />WHEREAS, Orange, Person and Chatham counties have continued to provide <br />mental health, developmental disabilities and substance abuse services through <br />Orange, Person and Chatham Mental Health, Developmental Disabilities and <br />Substance Abuse Authority (OPC Area Program) while administrative activities <br />were begun to implement the Interlocal Cooperation Agreement; and <br />WHEREAS, since July 1, 2004, mental health system reform has been subject to <br />a dizzying array of technical memoranda, conflicting communiques, restrictive <br />rulings, executive edits, and shifting policy directives regarding system reform, <br />including decisions to divest local management entities of two of the primary <br />functions vested in them under the system reform statute; and <br />WHEREAS, as a result, the process of converting from an area authority model <br />to a multicounty program model as contemplated by the Interlocal Cooperation <br />Agreement would dilute already overtaxed resources. <br />NOW THEREFORE BE IT RESOLVED that the Board of Commissioners of <br />Orange County hereby ratifies the adoption of an amendment to the Interlocal <br />Cooperation Agreement to allow its immediate suspension and, upon the <br />adoption by Person County and Chatham County of corresponding resolutions, <br />the Board of Commissioners of Orange County resolves to suspend the Interlocal <br />Cooperation Agreement by agreement of all parties. <br />This 4th day of May 2006. <br />~c~.-.~ <br />~~~ <br />5- y~ ~~ G <br />9 -~ <br />Barry Jacobs, Chair <br />Orange County Board of Commissioners <br />
