These uses include <br />hotels/motels, multi-family dwellings, assembly facilities, nightclubs, and ~-°°,3 <br />higher impact retail trade. Rezoning to EG-S would provide a margin of added <br />protection for the University Lake Watershed and would be consistent with the :~ <br />Zoning Ordinance and JPA Land Use Plan since the property is no longer in an <br />activity node. <br />The Planning Staff recommends approval of rezoning the property <br />from Community Commercial-3 to Existing Commercial-5. <br />The Planning Board will prepare a recommendation on the proposed <br />amendment at its December l9, 1988 meeting. The Board of Commissioners will <br />consider the proposal for decision on January 3, 1989. <br />Commissioner Hartwell asked what benefit this rezoning would have <br />for the applicant. Crudup responded that there are existing commercial <br />structures, warehouses, on the property. The use proposed by the applicant is <br />not allowed in CC-3 but is allowed in EC-5. The rezoning would make it <br />consistent with the Land Use Flan since the node was removed when the Joint <br />Planning Area Land Use Plan was adopted in October 1986. <br />Planning Soard member, Steve Yuhasz, asked why the EC-5 <br />designation was not assigned at the tiime the node was removed. Crudup responded <br />that it was an oversight at the time and should have been EC-5. Yuhasz asked <br />about buffer requirements. Crudup responded that the landscape requirements are <br />very similar for EG-5 and CC-3. <br />Motion was made by Commissioner Hartwell, seconded by Commissioner <br />Marshall to refer Z-S-88 to the Planning Board for a recommendation to be brought <br />back to the Soard of Commissioners no sooner than January 3, 1989. <br />VOTE: UNANIMOUS. <br />b. Z-6-88 Dale G. Davis <br />The presentation was made by Eddie Kirk. <br />The property in question is located on the north side of US <br />Highway 70 approximately 385 feet west of the intersection with Buckhorn Road (SR <br />lll4). The applicant, Dale G. Davis, is requesting a rezoning of Lot 9 of Tax <br />Map 2S - Cheeks Township. The property proposed to be rezoned contains 51.712 <br />square feet or 1.19 acres. The current zoning of the property is R-1 (Rural <br />Residential) and PW II (Protected Watershed). The proposed rezoning is EC-S <br />(Existing Commercial) and PW II (Protected Watershed). <br />The area is designated as 10 Ten Year Transition in the Land Use <br />Plan. The applicant indicates that the existing use was in operation in 1984 <br />when Cheeks Township was zoned. The existing commercial building is located on <br />two lots and the lot line runs through the building. Only one of these lots was <br />zoned commercial <br />in 1984. The applicant is requesting the other lot be rezoned to allow the <br />building to become conforming. <br />The Planning Staff recommends approval of the proposed rezoning. <br />
