Article 4 - Permitted Uses, Article 8 - Special Uses and Article <br />22 Definitions (Day care Facilities) <br />The presentation was made by Marvin Collins. <br />These proposed amendments would revise existing provisions <br />applicable to day care facilities so that they are consistent with State <br />licensing requirements. <br />Day care, day nursery, and kindergarten facilities of all types are <br />currently permitted in residential zoning districts upon approval of a Class B <br />Special Use Permit. In commercial and office zoning districts, such facilities <br />are permitted by right. <br />It has been brought to the attention of the Planning Department <br />that erroneous information was provided to Child Care Networks 4 1/2 years ago. <br />The information provided indicated that no permits of any kind were required for <br />such facilities. For this reason, permits have not been obtained by those <br />facilities within Orange County's jurisdiction. <br />Another concern identified by staff of Child Care Networks is the <br />inconsistency between State licensing requirements and the permit requirements of <br />Orange County. The State requires that day care facilities of a certain size and <br />operating certain hours be licensed, whereas Orange County requires that all such <br />. facilities <br />in residential areas be required to obtain a Class B Special Use Fermit. The <br />staff of Child Care Networks has recommended that Orange Gounty's zoning <br />provisions be amended to be consistent with the State licensing requirements. <br />The proposed amendments incorporate the definitions of "day care" <br />and "day care facility" from the State licensing requirements into the Zoning <br />Ordinance. The zoning Districts in which day care facilities are permitted, by <br />right and upon approval of a Class B Special Use Permit, would remain unchanged. <br />The standards for evaluation of a Special Use Permit application <br />have been proposed for amendment. The proposed changes would include the <br />following: <br />a) The day care facility is to be located in an area which is <br />free from conditions dangerous to the physical and moral <br />welfare of the children. <br />b) The minimum requirements to qualify for a State of North <br />Carolina day care facility license are satisfied. <br />c) There is direct access from the property on which the day care <br />facility is to be located to a State-maintained road or a <br />private road approved by Orange Gaunty. <br /> <br />
