i <br />~~~ <br />is contiguous and does not increase its land area by more than one <br />hundred acres. He identified the present transition area and that <br />proposed as Ten-Year Transition Area on a large map which was an display. <br />He also identified the proposed park site. <br />Collins noted that one problem discovered by Staff in review of the <br />application was that more than the 100 acres permitted by the Ordinance <br />had been included (a total of 116 acres including street, railroad and <br />utility rights-of-way). After discussion of this problem, the applicant <br />revised the map downward to include only 91 acres. $isecting this <br />property is a stream which follows the path of the two lakes and exits to <br />the north across the Southern Railroad. The area generally south of Old <br />NC 10 has been deleted because it is a part of a Resource Conservation <br />Area shown on the existing Land Use Plan. That would limit all the <br />Transition Areas to areas outside of any floodplain or any area <br />designated as having steep slopes. <br />Collins stated that the map he was using was a general concept plan that <br />the applicant submitted with the application to show how the proposed <br />amendment is in compliance with the Comprehensive Plan. How the <br />amendment will carry out the intent and purpose of the Comprehensive Plan <br />is a requirement of any amendment approval. He noted that the proposed <br />park site will incorporate approximately twenty-five (25) acres and <br />carries out the intent of the Master Recreation and Parks Element of the <br />Comprehensive Plan. If this application is approved and a subsequent <br />rezoning or planned development application is submitted the applicant <br />would be required to dedicate to the County a minimum of twenty-five <br />acres for a park site. The provision of a golf course within the <br />development also satisfies the intent of the recreation element. Even <br />though it is a private golf course, it will be made available for public <br />use. <br />The proposed amendment is also consistent with the goal in the <br />Comprehensive Plan of preserving the rural character of the County since <br />out of the total of 575 acres which will ultimately be included in this <br />community, 250 acres have been designated for lakes, <br />a park and a golf course. The location of the golf course and the park <br />site preserves the open areas that exist on the site now. The <br />development density proposed, 1.5 units per acre, is in keeping with the <br />low density character of the area. <br />In terms of location standards such factors as land slope, hydrology, <br />flora and fauna, population density .and historical and cultural <br />resources, etc, are considered when determining whether or not to apply a <br />transition area designation to a particular site or group of sites. <br />Collins indicated that he had reviewed each of the criteria used and the <br />results of that review is included in the staff memorandum which is in <br />the permanent agenda file in the Clerk's office. <br />Some of the concerns include the proximity of the Eno Division of Duke <br />Forest and the overhead power line easement in the same area. <br />The tracts in phis application have been designated in the Land Use Plan <br />as being in agricultural use.
