~~~ <br />sell to Habitat for Humanity a lot to be used for the construction of low and <br />moderate income housing by private sale at a negotiated price and adopt the following <br />resolution: ~-~ <br />WHEREAS, Orange County owns a tract or parcel of land located on Riddle Avenue in the <br />Northern Fairview Community in or near the Town of Hillsborough, North <br />Carolina, and <br />WHEREAS, that property was acquired by Orange County as part of the Northern <br />Fairview Community Development Project, and <br />WHEREAS, Habitat for Humanity has expressed an interest in acquiring the Riddle <br />Avenue property, constructing a home thereon and selling the home and land <br />to a person or person qualifying for Habitat for Humanity's low and moderate <br />income housing program, and <br />WHEREAS, the Riddle Avenue property has an appraised value for Orange County <br />taxes of $4,000, and <br />WHEREAS, the low and moderate income housing program of Habitat for Humanity, in the <br />opinion of the Orange Gounty Board of Commissioners, carries out a public <br />purpose, and <br />WHEREAS, Habitat for Humanity has. indicated a willingness to purchase the Riddle <br />Avenue property for the sum of $4,000 and has indicated a willingness to <br />contract with Orange County for its purchase at that price pursuant to a <br />contract which would contain convenants and conditions which assure that the <br />property will be used for housing for persons with low and moderate income. <br />IT IS THEREFORE RESOLVED THAT <br />1, Orange County, pursuant to North Carolina General Statues Section <br />160A-279, is authorized to sell to Habitat for Humanity, by private sale at <br />a price of $4,000, the property owned by Orange County located on Riddle <br />Avenue in the Northern Fairview Community of Orange County, <br />2. The Chair to the Board of County Commissioners is authorized to execute <br />a contract on behalf of Orange County containing the specifics of the sale <br />which contract shall contain such covenants and conditions as deemed <br />appropriate by the Orange County attorney to insure that the property will <br />be used by Habitat far Humanity for the purpose of providing housing to <br />persons with low and moderate income. 3, The Clerk to the Board of County <br />Commissioners, pursuant to North Carolina General Statutes Section 160A-267, <br />is hereby authorized and directed to publish a notice containing this <br />resolution- one time in the Durham Morning Herald and the News of Orange <br />County which notice shall be published at least ten days prior to the date <br />when the sale of the Riddle Avenue property is consummated, <br />4. The Chair to the Board of County Cammissioners is further hereby <br />authorized to execute, in a farm approved by the Orange County attorney, a <br />deed on behalf of Orange County to the Riddle Avenue property conveying the <br />Riddle Avenue property to Habitat for Humanity. <br />Adopted this the 19th day of July, 1988. <br />VOTE: UNANIMOUS. <br />7. BUDGET AMENDMENT <br />Motion was made by Commissioner Willhoit, <br />to amend the 1988-89 Budget Ordinance as follows: <br />COMMUNITY DEVELOPMENT FUND <br />Appropriation: <br />Outside Agencies (Habitat for Humanity) <br />Source: <br />seconded by Commissioner Hartwell <br />$ 4,000 <br />
