~-~~ <br />Residential-1 and the Land Use Plan designation is Rural Residential. <br />_. _ The Administration recommends approval with the extension and dedication to <br />Orange County of the 50-foot right-of-way from the cul-de-sac on Jacobs Trail to the <br />eastern property line. The acceptance of the dedication by the Board is also <br />recommended. Actual construction of Jacobs Trail would terminate in the temporary <br />cul-de-sac as presently shown. <br />Motion was made by Commissioner Hartwell, seconded by Commis-sioner Halkiotis <br />to approve the Administration's recommendation. <br />VOTE: UNANIMOUS. <br />3. OAK CREST SUBDIVISION-PRELIMINARY PLAN <br />The property is located in Chapel Hill Township near Star Point at the end of <br />Booth Road (SR 1531) on the Orange/Chatham County line. The tract is zoned Rural Buffer <br />and Protected Watershed II. The Joint Planning Area Land Use Plan designation is Rural <br />Residential. Thirty-eight (38) residential Iots are proposed on the 113.99 acre tract. <br />All lots are over two acres in size. <br />The Administration recommends approval per the Planning Board Recommendation <br />with three changes which are included in the conditions listed below in the motion. <br />Planner Emily Crudup and the developer of the subdivision answered various <br />questions from the Board. <br />Motion was made by Commissioner Hartwell, seconded by Commis-sioner Halkiotis <br />to approve the preliminary plan for Oak Crest Subdi-vision with the following 11 <br />conditions and accept the dedication of the right-of-way. <br />1. Provide restrictive covenants for review by the County Attorney which <br />include a prohibition on further subdivision of the thirty-eight (38) lots <br />shown on the preliminary plan as well as provisions for maintenance of <br />drainage easements and stormwater detention facilities. (Final plat <br />requirement) <br />2. Approval of the access easement agreement with accompanying plat by the <br />~.' County Attorney. (Final plat requirement) <br />3. Provide a warranty deed to Orange County for the 5.86 acres of <br />recreation/open space in the format recommended by the County <br />Attorney. (Final plat requirement) <br />4. Approval of the stormwater management plan including provisions to control <br />the peak rate of runoff for the 10-year storm to the predevelopment rate. <br />5. Provide a registered engineer's calculations and certification that <br />proposed improvements to the road crossing at Price's Creek will not <br />decrease the flood carrying capacity of the stream. <br />6. Provide a note on the final plat which restricts access of lots l9, 20, 21, <br />and 22 to the cul-de-sac at the end of Booth Road; lots 14, l5, 16, 17 and <br />l8 to Cedar Run Lane; lots 7, 8, 9, and 10 to Ridge View Lane; and lots 34, <br />35, 36, and 37 to Shiners Place. <br />7. Obtain approval of the erosion control plan and apply for the required <br />grading permit prior to any site disturbance. (Final Plat requirement) <br />8. Provide a 30-foot public pedestrian and non-motorized vehicle access <br />easement to connect the dedicated recreation/open space <br />to the Heritage Hills Recreation Area. <br />9. On the final plat, label the 5.86 acres on Price's Creek as "Dedicated to <br />Orange County for Recreation/Open Space Purposes." <br />(Final plat requirement) <br />l0. Combine lots 26, 27, and 28 with other lots or label thew as being of <br />restricted development potential and not for building purposes.
