al <br />D-4 <br />approval must be approved in writing by the AGENCY/GRANTEE <br />prior to the RECIPIENII SUBGRANIEE's submission of a <br />closeout package. Any closeout package received prior to the <br />written approval of'said amendment is considered void ab initio, <br />and is not considered a closeout package for the purposes of <br />eligibility or potential penalty issues related to closeout.. <br />10.. Submission of'inaccurate information by the RECIPIENT/ <br />SUBGRANIEE in monitoring report responses; audit or audit <br />finding responses; quarterly, closeout, px•ogr•am income, or other <br />x•eports; or' Requests for' Funds that x•esult in subsequent official <br />AGENCY/GRANTEE action based on that inaccux•ate information <br />(such as the granting of administrative or final closeout status, <br />releasing funds, or• clearing findings) may at the option of~the <br />AGENCY/ GRANTEE, subject the RECIPIENT/SUBGRANTEE <br />to revocation of'the official AGENCY/GRANTEE action(s) <br />predicated on that report or submission, (e..g., revocation of closeout <br />status, audit clearance, monitoring report clearance, etc..). <br />{e) Where applicable, it will comply with: <br />(1} Contract Work Hours and Safety Standards Act of 1962, 40 <br />U.S..C.327 et seq., requiring that mechanics and laborers (including <br />watchmen and guards) employed on federally assisted contracts be <br />paid wages of not less than one and one-half times thefr basic wage <br />rates for all hours worked in excess of forty hours in a work week; <br />and <br />(2) FederalFair• Labor Standards Act, 29 U.S.C..
