Phase I consists of 47 single-family <br />residential lots served by new public roads, individual septic systems, and a <br />community water system. The Final Plat of Phase I, Section I, was approved and <br />recorded on April 16, 1997. Section I contained nine (9) lots and approximately 24 <br />acres of open space. Part of the open space was included in a Conservation Easement <br />Dedicated to Orange County and accepted by the Boazd of Commissioners on <br />December 17, 1996. <br />The roads and water system in Section I were completed and approved by <br />appropriate authorities. The road rights-of--way were accepted by Orange County on <br />behalf of the public with approval of the Final Plat. The developer had not requested <br />that NCDOT take over maintenance of the roads because the State's minimum <br />density requirements had not been satisfied. No lots have been sold and no building <br />permits issued in Section I. <br />
